I have a TENANT that is most likely going to be hit with the same fees from DISH network for a similar situation.
He moved into my rental unit and on November 2, DISH went ahead and installed 2 dishes on the side of my building (about 20-25 feet UP from the driveway) without my permission (I was visiting my sick Aunt in a hospital.) As a result of the installation, the installer broke 4 of my wooden siding panels. Also the dishes are within 2 feet of an external power line and the antennas and the RG-6 coaxial cables are NOT GROUNDED. In the City of Buffalo, all outside antenna installations mounted to a multiple dwelling are required to be properly grounded IAW the National Electrical Code. (Just so folks know, my units are prewired for cable and that installation IS properly grounded.)
Further, these dishes are in a HIGH WIND area and if they fall down and cause damage, I am responsible-not them! I am attempting to resolve this without going to court or cost to my new tenant but either way, these dishes are coming down before January 2010 (historically, Jan-apr is high wind/ice storms in our area.)
I'm fighting with DISH and their installation company to make them PAY to relocate and/or remove this antenna installation and restore my siding to the condition it was in prior to their install. So far, they do not appear to be willing to fully restore my siding. They have offered to "calk" the screw holes when they remove the antennas-that's not good enough.
The installer claims they are indemnified by their service agreement with the tenant. Sorry, but I am not a party to that. All that means to me and my attorney is that AFTER I successfully SUE THEM they may, at their option, sue my tenant.
