I attempted to finance a 2004 Mitsubishi Montero from Sands. I paid them $1200 down payment. Even though it broke down 5 days after purchasing it I wanted to get it fixed and keep my truck.

I immediately contacted Sands to see what was covered under my warranty, initially it seemed like they would take care of it, but after I initially received no return calls I seen they were not going to assist.Then days later I was contacted by there sales manager who obviously knew nothing about the situation and he stated to me that if I did not tell them were the vechicle was that he was going to call it in stolen, because it was not mine. Never did I withhold the vechicle from them, being it was sitting were I had it towed to after it broke down.

Sands came and towed the vechicle, and me and there managers had a few "choice words" I was appaled they accused me of withholding the vechicle and never advised the vechicle was not mine. I contacted them the next day and they said I would have a check for my $1200 down payment in 30 days. I am here because it was never received, there has been a whole lot of communication in between, but in the end they state I am not eligible to receive my down back.

Within all this I find out that I was never financed for the vechicle, as the financing company advised me, Sands is trying to hold me responsible because they were not able to get me financing for my truck (NOT MY FAULT). I went there looking for financing, I was so happy with what they were able to do, well now I see not do. 

I did not ask them to take my vechicle from me (I even wanted it after it broke down the 1st week), I was advised it would be called in stolen and it was not mine. When I purchased it I was under impression I was financed, if I failed to meet a requirement of the financing company, then that is not my problem, you should not have told me I was. This was the first time I bought a car from a dealer, but as I can see over the internet now it happens to alot of consumers. I deserve to get my down payment back, and I am willing to go to court for it, I should not suffer for there negligence.

They made out like a con artist, still sold the vechicle to someone else probably for the same exact price cause I only put maybe 100 miles on it, its not right and for a company that has been "Serving" our community since the 1930's they need to do the right thing and return my down payment.

Spot Delivery..

They did what is known as "Spot Delivery".  This is where they let you take the car before you are officially financed, and is actually very common.  While some dealers are up front about this and let you know.  There are other dealers who know that there is no way you will get financed under the terms they gave you so they don't tell you.  These dealers will usually wait about a week before they try and get you into the dealer on some false pretense.  Then they give you the "bad" news that they couldn't get you financed.  Their hope is that since you have had the car for a while you will then just accept the higher downpayment and interest to keep "your" car.

I would not be surprised if the sales manager actually did know of the state of the truck, and that is why they were upset.  He probably figured that because it broke down there is no way they are going to get you to agree to the higher terms.

The other trick that they do is that they put into the contract that if they can not get you financed and you turn in the car/truck they can assess a daily "rental" fee for the car.  This clause usually wipes out most(if not all) of the downpayment. 

This is why you read every single thing in the contract.  If you do not understand it..do not sign it.  If they refuse to explain it to you...walk out.  This does not just go for dealers, but any legal document that you sign.
