My car was hit by a ford F250 in a parking lot. The guy who hit me has Allstate insurance. I was in a space, saw the driver enter the lot, waited for him to pass me, then I reversed out of my spot to exit the lot. At this time the other driver was not yet parked but waiting in the lane. After I was fully out of my spot and in drive to turn right the driver of the Ford reversed to let someone out and didn't see me. I attempted to honk my horn but because of the airbag and horn location did not before he hit my driver side door. He addmitted fault and said he only looked in his rearview mirror and didn't see me. His pickup was high off the ground.

I got 4 estimates for the damage and the average price was around $1800.00. They lokked at my car and came up with $1300.00. Then I called the Philadelphia office and was told I was 15% responsible for the accident because I was not aware of my surrondings. After talking to the supervisor she lowered it to 10%. I was told this is part of Pa law. Now I will only get 90% of the $1300.00 and 90% of any rental car I need, up to $20.00 a day. Where do you rent a car for $20.00 a day?

I feel like I got screwed. In no way was I responsible. Plus they low balled my estimate. If my deductible was not $500.00 I would have used my own insurance company but don't have the money. So I'm stuck with this crummy offer from Allstate and the option to sue the driver for the diffrence which I plan to do. as a result Allstate not only screwed me but their customer as well.

Typical Insurance Company response

I had a similar problem with Farmers Insurance. Also ina parking lot and I was standing still, other driver backed into the side of my car. Farmers tried to tell me I wass 50% at fault.

I told them to drop dead and filed suit against the other driver in Small Claims Court.

Farmers settled real quick and I got full payment for the damage to my car. Maybe you should just ignore Allstate and sue the other driver and the owner of the car.

Some info for Paul..I had Allstate for 17 years..Here's how they work..

Paul,

I can say, this is not typical of how Allstate works. You do not have to take the offer. Contact the corporate office in writing, send by fax and by certified/rrr.

As far as the $20/day rental coverage, this is the amount you decided to pay for when you bought your policy. Loss of use coverage is very cheap, and the difference between $20/day and $40/day is about 10 bucks every 6 months.

You can sue the other driver for your losses. Be sure to put it in an "Allstate PREFERRED SHOP" because they have strict time limits on completion, and if additional damage is found after the work is started, it is automatically covered.

Put your car in right away and get your rental car. Keep your reciepts for out of pocket items, and use a credit card for everything for good documentation purposes.

Is the other driver an Allstate customer also? It sounds like he may be. Otherwise they would pay 100% and just go after the other driver's insurance.
