Good luck on your case. But FYI, it's not illegal to refuse to pay out on a claim for any reason. The insurance company represents the insured and can decide to defend or settle any claim based on it's individual merits. It's a civil matter and they can weigh their chances of success in court/the possible cost of going to court and act accordingly. If you disagree with their decision, your only option is legal recourse. It sounds like that is what you are doing, so kudos.

I am in a similar situation, but I was not cited. The other driver was cited, who also went to court, lost, appealed it, and then lost in appeals. All the time comitting purjury by changing the location and what happened.

We have cell phone GPS (not tower triangulation) coordinates that were transmitted when the 911 call was made, also a recording of the 911 call stating the location as well.

This occured on Dec 27, 2007. Here it is nearly 1.5 years later, and I am still driving a wrecked truck, suffering my back injuries, and tons of mounding medical bills with no way to pay them.

They even offered a 'insulting' settlement of $765 (impressive eh!!)...which does not even cover the cost of a fraction of the damage to truck.

Allstate is KNOWN for lying, cheating, stealing, etc too keep from paying claims.

Kim: File your suit against the driver of the other car, not against the insurance company. It was the driver that caused the damage. The insurance company will get involved, but the action should be against the driver.

- How can you afford the exorbitant insurance from the accidents you cause in the vehicle you shouldn't be able to afford if you have no money as you claim in the collection report?

- How can you afford a computer to perpetrate your fraud with if you have no money like you claim in the collection reports you pollute?
- How can you afford an internet connection to perpetrate your fraud if you allegedly have no money as you claim?
- How can you afford an attorney for all these alleged lawsuits you claim to be filing if you have no money like you claim?

These businesses are far from being innocent. Quit defending them your just has guilty buy giving the victims a hardtime just like these crook businesses do.
