involved in accident 12/06. rear ended at stop light by other car. was in mother in laws car at the time. she has american family(problem 1)

american family policy has 10,000 dollars of med pay. retained lawyer in feb/mar 07 for accident as at fault drivers insurance did not feel the need to fix my car, stating i backed into their clients car (rriiighhtt)

lawyer sent paperwork to american family and calims rep Regina Tashjian with all papers and names/addresses of all persons seen by me in reguard to the accident. this happened in march 07. all bills were to be paid by american family on med pay.

so if they recieved all the info, i have proof the items were sent and american family notified, why two bills, one for 34 dollars for x-rays, and one for 300 dollars for the ER, were never paid?

the case was settled in january 2008, only then did these idiots realize the outstanding bills and pay them. well guess what? they went to collections in APRIL 2007!!! these dumba**es were notified by the collection agencies too.. seeing as i gave the original creditor my lawyers info, american family info, at fault drivers info...yet the crap still isnt paid??

i call Regina Tashjian about this and i get some stupid question "were you involved in the accident?" no dumba**, im calling for pure joy...

i tell her ahhh duh??!!! and explain the issue. she says she never got the paperwork. BS it was sent 10 times at least. so i fax the paperwork, and only after that did the bills get paid. i was told i was a liar, my lawyer was a liar, and that if i had a problem with her, i could turn her into the department of insurance..so i did :)

after complaining with rejina's boss sandy, i realized these people are useless. they keep no record, they dont do their jobs, and customer service is non-existant. i sure as hell would never have them as my insurance company. and considering the accident wasnt even close to my fault, the treatment i recieved is ubsurd.

i now have to fight with the credit bureaus to get the mark taken off, by proving it was the responsibility of american family to pay the bills on time not me. prove i had a lawyer at the time. send letters to the collection agencies (who have been surprisingly understanding) and try and get this all straigtened out.

does anyone know exactly what i should do to fix this stuff on my credit report?

just wanted to share my experiences. i will update if i have to sue them to remove the marks, or ifi hear back from the dept of insurance

Don't Blame American Family

Problem 1) You were rear ended by someone who wasn't paying attention. Be upset with them for even hitting you.

Problem 2) If this other person truly rear ended your vehicle, that's odd that her insurance company would try to say you backed into her. Did you have a police report to sustantiate your story? If it was your word against theirs, this is possible, but it would be your fault for not calling police.

Problem 3) Why would American Family pay ALL your other medical expenses, but not pay for the 2 measly ones of $34 and $300. That's pocket-change to them. I would imagine they truly didn't get the paperwork. Why would you send it 10 times? Why would you not call them to confirm they received it after the 3rd time?? Why just keep sending it if they're not getting it?????? Your story does not make sense.

Problem 4) Where's the blame for the lawyer in this? He's your laywer right...he's working for you? Why is he not following up to make sure the insurance company has paid all the bills and why didn't he ensure they received the paperwork?

Problem 5) When you go to a hospital, it's your responsibility to pay them!! Granted, there may be coverage for the medical bills under an insurance policy as there is here, however, it's still your responsibility to take care of the bills. That's like saying I'm going to jack up my credit cards and use my tax returns to pay them off. If I don't get my tax returns early enough and my payment goes past due...I can't blame the IRS and I can't tell the credit card company to remove the fees because somebody else's money was going to pay for it.

Problem 6) This one piggy backs Problem 5. Why are you not angry with the hospital? Why didn't you explain to them that this was in conjuction with an auto accident and they should send the bills to the insurance company? And why did they send your account to collections if they knew the insurance company would pay for it eventually?

Your anger in this whole situation needs to be spread out over 3-4 different people and not just the insurance company. It's a little ridiculous that you're blaming them for everything that has gone wrong.

no kiding, her insurance company paid ME 10,000.00 IM SURE THEY FIGURED OUT WHO'S FAULT IT WAS, AND YES THERE WAS A POLICE REPORT

BECAUSE THESE BILLS ARE SEPERATE. THEY ARE BILLED SEPERATLY FROM THE OTHER HOSITAL BILLS. THEY ARE FOR PRIVATE CARE DOCTORS WHO READ THE X-RAYS, AND THE PHYSICIAN WHO IS HIRED ON CALL FOR THE ER, BUT DOES NOT WORK FOR THE HOSPITAL. THEY ASSUMED WHEN THEY PAID OUT 7 GRAND FOR BILLS THESE WERE INCLUDED..THEY WERE NOT

DONT YOU THINK I DID THAT? BUT STUPID RETARDS AT AMERICAN FAMILY STILL DIDNT PAY. SUBSIQUENTLY THEY DONT HAVE MY INFO BECAUSE ITS BEING HANDLED BY AMERICAN FAMILY, BUT BY LAW THEY CAN REPORT ANY UNPAID BILL TO COLLECTIONS AFTER 180 DAYS. WHICH IS EXACTLY WHAT THEY DID.

IT WAS ONLY AFTER I PULLED MY CREDIT REPORT THAT I FOUND IT WAS A LIE. AMERICAN FAMILY IS THE ONE RESPONSIBLE FOR 99% OF THIS PROBLEM. IF THEY DID THEIR JOBS, AND PAID THE BILLS, THIS WOULD NEVER HAVE HAPPENED.

As I was trying to state, how can you expect American Family to do their job if they NEVER RECEIVED THE PAPERWORK...I.E. BILLS??

Like how I put that in caps like you do? Does it get the point across any better?

You even say it yourself. They assumed they were paid out already and they were not. Right there...listed under "Problem 3)" in case you have trouble finding it.

Another one of your points:

It is your responsibility they are paid after the settlement. Forgive me because I don't know Nevada law, but it appears they gave 6 months to pay. Again, don't know how insurance companies can pay a bill they don't have because it never got to them?? Once the hospital did not receive payment from your lawyer or the insurance company, it becomes your problem again to pay the bill and they should've contacted you giving you a chance to pay before sending to collections.

Is it considered ***lying*** when they speak the truth to "the best of their knowledge?". Again, if they didn't have the bills, they couldn't have known there was outstanding debt.

The hospital didn't have your info? Really? Did they treat you as a Jane Doe? No name, address, phone #? Nothing?!?!? That's great!

As I stated in my closing arguement...your anger should be spread out across different individuals. I'm not saying you shouldn't be angry at American Family. Hell, I probably would be too if I was in your shoes. I was just simply pointing out the fact that your whole story is about how this insurance company is so terrible but it seemed to be a colaboration of mistakes behind everything.

I do not work for AFI but I used to get so tired when I worked in the field for people always pointing fingers at big companies. Not that I don't work in the field anymore, I can say how I really feel.

Granted, big companies make mistakes all the time, but when things aren't their fault people are quick to point the finger with their whiny sob story....poor me, poor me. This company sucks because they won't pay for my stupidity. (Doesn't apply to you because you were hit by the stupid person, but the next point does apply to you) Take some responsibility and quit pointing the finger. You are an adult who should know NOT to rely on other people to get things done for you...i.e. make sure paperwork gets delivered, and who is probably capable of following up with people to ensure things get done....i.e. call American Family to ensure they got the paperwork after faxing it 10x.

ps-im sure people move, and change numbers and whatnot...perhaps thats a reason why the hospital never sent anything...duhhhh (oh, and again its still not my job to update them, thats what my lawyer is for)

pps-i said they did in fact recieve the bills on time. so blaming AFI is my choice. they are a big company shitting on the little guys, and its dickheads like you that make it all possible. they actually called my lawyer and yelled at them for filing suit for not paying the bills in a timely mannor. thats right, im suing them, you know with all that proof i dont have ***rolls eyes***

OP Wendy, re-read what you have written. ANY TIME you receive medical care, you sign documents accepting financial responsibility. The medical provider may file your insurance, but it is up to you to make sure the payment is ultimately made. You have a classic victim personality. Take some responsibility for what has happened here, learn from it, and move on.

Did not pay med-pay?

Well..... It would seem that the adjuster would be in violation of the Un-Fair Claim Practice. The adjuster would have to act on the medical bills that came across her desk with-in a timely manner, and in this case it appears that she did not. Your attorney should have known this and filed a complaint in court naming this carrier and the adjuster for this violation. Being an adjuster I have a very strict guideline when paying the insured's (your) claim.

In this case, the adjuster did not review the medical bills and pay them in a timely manner so there for the bills got sent to collection; you can show damages to the court by the amount that got reported to your credit report. I would speak to your attorney about a complaint he/she should file with the court on unfair claims practice.
