I don't have Geico Insurance but I was rear-ended by one of their customers. The accident happened at night in a parking lot, the other car just completely failed to stop and rammed his truck into my car. When I got out of my car, the Geico customer staggered out of his car and said, "Wow, I didn't even see you there." I got his information (VIN, policy number, phone number, address, etc).

I didn't call the cops because honestly I was afraid that the drunk was going to turn on me and I had my younger brother in the car. I offered my information twice to the guy and he refused, saying that it was all his fault and he would take care of it. He kept saying he would pay. My car sustained alot of damage, and I injured my neck and shoulder and my brother injured his neck and had a bump on his head. At first i filed with my insurance and they told me to file with Geico because he was clearly at fault (by texas law if your rear-ended it is automatically the fault of the person who rear-ended you).

So I filed with Geico, an adjuster came to my house to look at the car, because my car wasn't drivable. He told me that he was considering my car a total loss. When I informed him that it had a brand new motor in it with only 8,000 miles. He just ignored me. Then I called Geico and talked to the person in charge of my account, she said that she was waiting to get the story from their client, because they couldn't contact him! They called him and they sent a person out to his house but they couldn't find him. I think he skipped town or something. The adjuster said that since I didn't call the cops I couldn't prove that he was actually at the site of the accident. THEY TOOK TWO MONTHS and then told me that they were not admitting fault. So now I have to file with my insurance and pay my deductible. My insurance said that they would go after my deductible and the medical expenses.

I'm so infuriated with Geico, the adjuster kept insinuating that I was a liar and a fraud and the car inspector was a jacka**. I think they stalled on me because I mentioned the guy was drunk. If they admitted fault it would have opened a door for a huge lawsuit. So they played dirty.

Because of this I will never use Geico! Don't fool yourself and get Geico, they don't even pay out if someone steals your car. Look at the other rip-off reports.

That's why you always file a police report

Without the police report, there was no proof that anything happened. First they have someone claiming to be in an accident with one of their clients, then that person claims to have a brand new engine in the car that was totalled, plus medical expenses for two people. You can see how it would look like fraud to them. You would need some sort of proof, like the receipt for the engine and something from your doctors.

Also, not calling the police because you thought the guy would turn on you? That would be a reason you SHOULD call the cops. You could also have had your brother call the police while you kept the other driver busy dealing with the accident.

I don't know about Texas, but where I live, it's illegal not to file a report in an accident. They'll suspend your license and you have to pay a re-issuance fee, plus your insurance goes up and there are probably other fees and fines as well.

It's always a good idea to get a police report. The insurance company cannot pay until there is some proof that the accident happened. In this case, they have no way to confirm your story and so long as they have taken reasonable steps to contact the other party, they haven't done anything wrong.

Assuming that you can prove what happened, your only recourse is legal action against the driver. You must serve him with a lawsuit, once he receives the letter he is obligated to answer and if he does not answer within the specified time you will win a default judgement, which you can collect from the insurance company. If he does answer then it's likely that geico will take over and try to settle it before it goes to court. In any case, you will need to prove what happened which is hard to do without a police report. However the only way to make absolute sure that the other party complies is to file a lawsuit.

I cant help but laugh

First... When they looked at your car it wasnt to stall things. They were trying to get enough proof of hat happened to help you. Secondly if there is nothing to prove the accident happened whose to say you didnt just make it up. They were not calling you a liar... they cant just pay for your damage and say to their insured they are doing it because you said the accident happened. They need to be able to prove to him they knew he was there. So before posting these comments think about how this really happened.

geico's hands wre tied b/c of no police report........look at your insurance card and on the things to do list of what to do...the 1st thing is to call the police....follow instructions
