I was recently in an automobile accident where a lady failed to yeild while making a left hand turn in front of me on a 55 mph highway.  I collided into the side of her car.  The accident completely totaled my car and I only have liability insurance through Geico.  I reported the accident to GEICO where they said that I was not at fault so I needed to contact the other persons insurance company.  After receiving the police report I find that the other driver also has GEICO liability insurance and is claiming along with her insurance adjuster that I am part liable for the accident.  I am currently  in a rental car waiting for GEICO to complete their investigation and feel like everyone is beating around the bush.  I understand the the law in Georgia is that if both parties are considered 50% at fault then no compensation is due to either party.  Because of this, I feel that rather than representing me the way an auto insurance company would if it were a different insurance company claiming that I am part liable, that GEICO is looking out for it's best interest instead of mine, as a paying customer.  They would rather give both of us half liability and pay no one then do what is just, which would be to protect my driving record, my standing with GIECO and my legal rights.

Can someone help me out by telling me what my rights are in this situation.  A decision has still not been made by GEICO.  What are my rights?  What is my next move?

in Texas you would be 100% at fault

Sorry:

In Texas the car in the intersection has the right of way, even if they crossed in front of you.  You are required to yeild right of way to anybody already in the intersection.

 you hit the other car on it's side, hence they were in the intersection first.

Sorry, this is why you should carry collision insurance to protect your property.  However a bright note, if your car was a fairly new car, and you are financing that car, check with your finance company, maybe they placed single interest insurance on your auto.  You might be able to get that insurance to pay for the damages.

You got lucky only getting hit with 50%, but I am sure this will still show up on your driving record, costing you points.

   You are sorely mistaken on this point. The car turning left must first yield to oncoming traffic. Where do you come up with this stuff??

 From the Texas code :

 Sec. 545.152. VEHICLE TURNING LEFT. To turn left at an intersection or into an alley or private road or driveway, an operator shall yield the right-of-way to a vehicle that is approaching from the opposite direction and that is in the intersection or in such proximity to the intersection as to be an immediate hazard.

 With that kind of driving knowledge, I'm amazed that you don't get T-boned on a regular basis.

  To the OP, about the only thing that could cause you to be even partially at fault were if you were travelling at an excessive rate of speed. If no one is saying that, I don't see how they could say that you were at fault.

   If Geico doesn't agree, your only recourse will be to file suit against the other driver.   Geico will be obligated to defend the other driver and explain to a judge how they came to the conclusion that you were at fault.
