My 21 year old son was hit by a drunk driver at 6:30 in the evening. The drunk driver, in his late model Jaguar, ran a red light making a left turn hitting a Mustang and my son's Impreza WRX. Of course the drunk wound up with minimal damage and even tried to run while my son and the other driver were being treated by EMT's. The driver was caught and arrested for DWI. The other driver had comprehensive insurance with State Farm, so Progressive handled him with kid gloves and paid his full claim. My son has liability because he can't afford more. State Farm, our insurance, will do nothing because of this. The drunk's insurance, Progressive, gave my son a car for four days. Then they lowballed a settlement based on half the value to replace the car. My son had owned the 2002 WRX for two months. He had put new tires and other parts on the car. We have sent them receipt copies for all improvements made on the car, but in return their "mechanic" said the car was only worth $4500. Comparable cars sell for between $8000 and $9000. The mechanic also lied and said the interior was trashed before the wreck, which is untrue, and said there was significant body damage, which is also untrue. There were two quarter sized marks on the driver's side front door. The adjusters have repeatedly tried to railroad my son into accepting the lowball settlement, even after sending many copies of receipts and after telling them we don't have all the ER and radiologists bills. The last time he talked to them, the supervisor yelled at him and told him "no lawyer will take this case (my son hadn't mentioned a lawyer) because the car was too cheap." I think the fact that a guy driving a late model Jaguar was DRUNK and cited for failure to yield right of way, leaving the scene of an accident and failure to render aid should count for something. My son's not asking for a new WRX, all he wants is enough money to replace what was destroyed-a blue 2002 WRX that he had saved for three years to buy. Progressive has been evasive-they never answer the phones but return calls later at their convenience. They have been abusive-yelling at my son and threatening him. This is the most unprofessional lot of people I have ever had business dealings with. We are now trying to decide whether to pursue legal action. This is why lawyers get rich.

First: Find a Public Adjuster

Unfortunately, some insurance companies act like they don't know you when a claim comes up.  Since your son only has comprehensive,  they are going to leave you to your own devices:  if he DID have collision then State Farm would be on the hook if the other company didn't pay up and you'd better believe they'd be all on this to defend your son / their money.

Search for a public adjuster:  they will independently appraise your son's car's value.  Do not sign a settlement until you do have ALL of the bills.  This would be paid for by your son.

Don't expect Kelley Blue Book retail value;  expect private sale value.  KBB.com says that that year & make (automatic with 100K miles for example) in "good" condition ("excellent" really only applies to cars being sold by Subaru, etc, dealers) would be worth $5775 trade-in / $7240 if sold privately.  This will vary a little depending on hat area of the country you are in.

If it does come to it, yes, a lawyer would take your case:  they have all the necessary forms, letters, etc, stored in their computer;  they just fill-in-the-blanks with your son's info.  It's not a difficult process.  A quick consult may let you know exactly where your son stands.

Hopefully your son was not badly injured.  Progressive is being ultradefensive due to their party being at-fault AND cited for DWI.

Get a personal injury attorney first, then they will do the car too

The FIRST thing you want to do is get a personal injury attorney. As soon as you sue for your son's injuries, they will get it right on the car damage too. Guaranteed. Almost all attorneys take these cases on contingency.

You never mentioned what state you live in or what state the accident took place in, and that is very important.

For example, here in Florida, the insurer is REQUIRED, ny law, to "make you whole".

This means if the fair market value of your vehicle is $8000 and they want to "total" it and your deductible is $500, you get $7500.

Insurance companies always try to confuse you and that is wrong. The law supercedes the policies of the claims department every time.

DO NOT let them "force" any settlement on you. You DO NOT have to accept any offer.

Get a lawyer right away or you WILL lose.

Here's what to do

 It sucks that you only have liability, less you could replace the car using your own insurance and they would subrogate progressive for the damages. Basically, you need to do what they would do: Replace car, send bill.

Just make sure the car you replace it with is comparable in miles, condition, year, make, model.  If you select a more valuable car, it's called betterment, which means you would be responsible for the difference in price.

Oh and personal injury lawyers are often an even bigger ripoff (just throwing that out there)
