I was in an accident involving a person who was insured by USAA. The person hit us while were on vacation in Vegas and we were in a rental car from Hertz that was in my name. At the scene of the accident, the 71 year old woman obviously had no perception of what she had just done, because she said the accident was our fault, so I had to get the police involved to have proof it was not. The other woman was cited and the police report indicated that she was at fault, so I thought this woman's insurance would pay! WRONG. They actually found the lady, NOT AT FAULT, even though the police report says VERY different!

Needless to say, Hertz just wants their money and of course I was the one they came after. I wasn't the one driving the rental, my friend was, but her Insurance coverage was not the best, so they didn't pay Hertz either.

I wrote letters to the driver of the other car, her insurance and Hertz letting them know I owe nothing and they need to go after the woman who hit us. I do not feel I have to pay, even if the Hertz car was in my name. No one really cared what I had to say and they really still don't. Obviously her lousy and lazy insurance company USAA needs to pay the balance!!

So, yesterday I receive a collection notice from Hertz, C/O United Collection Corporation!!!! The total being 1649.34. They seriously have to be kidding me!

I wrote a letter to them today, providing them with the information and letters I have sent thus far. I also asked them to cease and desist, but I am not a lawyer, so they probably won't listen to me. I tried to take the other driver to small claims, but in Ohio, where I live, you can't file a lawsuit on an auto accident involving a vehicle that is not yours. So again, screwed!

I have read many complaints about USAA and have talked to a former police officer in the CA/NV area who said they do this kind of thing ALL the time. Seems like a class action suit in the making!
