I had a t-mobile acct that went delinquent. Oct 2005 I settled the acct. It was placed with a collection agency, Superior Asset Managment. They, in turn, placed it with an attorney's office, Smith & Assoc. I settled the acct through the atty's office.

In Feb 2006 I tried to refinance my home & was told this was still showing on my credit as a collection acct. I contacted t-mobile & was told they showed it was settled & that it would take approx 3 business days for the correct form to be filled out in order to update my credit. In the months that followed I have contacted them numerous times & it still is not updated & here it is August!

I contacted t-mobile one more time yesterday & was told I had to contact the agency I settled it at in order to have my credit updated. I contacted Smith & Assoc & was told they dont report, I need to contact the collection agency. I then contacted Superior Asset & was told the same thing as Smith & Assoc - they are not a credit reporting agency & to contact t-mobile again. I did that this morning & spoke to a supervisor who told me to fax my dispute to them & within 72 hours I'll get a return phone call with a resolution. This is holding me up in refinancing my home. I've sent disputes to the credit bureau's directly & am waiting to hear from them as well.
There is no reason why, after 10 mo's, t-mobile will not update my credit report that the acct is settled. If you've had this problem, let me know how you handled it.

Carol...STAY OFF THE PHONE!!!...And...

Carol,

The first thing you have to do is stay off the phone!! You will never get anthing done over the phone, and the call "never existed" if you ever go to court.

Communicate ONLY in writing and by certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records.

Now, when you have a collections account on your credit report, ONLY contact the credit bureaus with the dispute and the specific people who reported it. The original "creditor" should NEVER be contacted as they cannot do anything once sold or assigned for collection.

You have the right under federal law that your credit report be complete and accurate. The FCRA gives you these rights. You can sue.

If you "settled" the account, than you should have proof of payment, right? That along with your dispute should get it removed.

Stay off the phone.
