T-Mobile sold me a phone that was defective and is requiring me to purchase a new phone to honor my contract. Bellevue, Washington

I purchased my sidekick slide in Dec 2008 and my phone crashed on me in March 2009. After asking to downgrade I was sent a replacement phone due to I would have been required to purchase a new phone at full price.

In Aug 2009 the trackball stopped working on my sidekick and I had to send the phone back. I asked again for a downgrade and was told no. I was sent another refurbished phone which looked in worse shape than the one I was sending back. I took the refurbished phone and it crashed once again after 2 weeks.

I called back into the T-Mobile and purchased a new phone from them. I did this because I knew my warranty would soon be up and I did not want to be stuck with a phone that may crash again after my warranty was up. I went into a store to look at the new phone and was then told by the rep that the phone never worked. It was best that I got a new phone cause no matter how many replacements I would get, it would continue to crash every time.

I called back into T-Mobile making them aware that it was unfair for me to purchase a new phone when I was sold a phone that was never going to work. I was told I already got a good discount on the phone I purchased and nothing else would be done. I then called into to corporate to complain about this issue. I feel that if I purchase a product I should be given a product that will work. If the product will never work then  I should be given a similar product that will work. I was then told by corporate that I was given the fullest discount and Customer Care gave me an additional $100 off as a courtesy. I made her aware it was not done out of courtesy but was a special promotion, available to everyone, due to be featured on the Oprah Winfrey Show. She then told me she was not aware of that however nothing more would be done. I then asked for the name of the CEO to write him. Ms. Ortiz in corporate gave me his name but told me in so many words that she would be the one go get the letter but she would not be forwarding it on.
