Earlier this year i ordered a telephone & service from Verizon. After receiving the phone i had misgivings seeing how expensive & overpriced it was. i cancelled the plan.

I wasn't able to return the phone in time to get a refund, I had to pay the full price of the phone $180 approximately.

Recently i found a reasonable plan @ Verizon for $15/month - a price more suitable to our income & my usage level. Even though the phone is my fully paid for property, Verizon is refusing to let me use my phone with a lower priced plan....

That is a clear, very nasty RIP OFF...

If i had not paid for the phone i could understand their attitude.

i paid all the charges they insisted i pay which included the cost of the phone.

if they won't let me use a phone i paid for, then they ought to take it back & give me credit for what i paid.

Question...

Why did it take you beyond the time you could return the phone to figure out that the plan was "overpriced and expensive"? When you got the phone you would have picked your plan and would have seen the costs BEFORE you even placed the order.

What was the phone(brand/model) you fully paid for?

What was the reason they gave in not being able to use the phone?

Too many holes to believe this story

1. If you didn't return the phone within the 30 day Worry Free Guarantee window, you would not then be charged full pice for the phone, you just would not be able to return it for any sort of refund.

2. If you then decided to cancel, there would be a $175 Early Termination Fee. Is that what you are talking about?

3. If so, and you never paid it and/or never terminated the line correctly, then you have an outstanding balance on an account that needs to be paid. The phone is tied to that line and will not be released until the balance is taken care of.

You need to provide a WHOLE lot more details than what you are giving her for your story to be taken seriously or get any good advice.

Too may questions

There are too many questions that need to be asked before something like this can be resolved.

Where did you get the phone? A corporate store or an indirect dealer? If so, they can have differing return policies as well as their own early termination fee.

Did the $180 charge come on your Verizon Wireless bill? If so, it may have been an early termination fee for breaking the contract, not the full price for the phone. Since I recently had to go shopping for a replacement, I got a good look at full retail and not a single one on display was less than $200.

Were you trying to start a prepaid plan with a touch screen, PDA or other advanced devices? With the limitations on most networks, those phones just won't work on with the prepaid network so cannot be activated (a cannot rather than a will not situation).

I think I can see what's going on here..

I believe that you have some things mistaken... I will try to explain:

That 180$ that you think that you used to purchase the phone, that is incorrect. Verizon does not do this. Instead I believe that you waited too long to end the trail contract that the only way out of your new finite contract was to pay a 175$ eairly termination fee. With this, you are still required to return the phone, and you can then drop your service.

What Verizon is seeing, is that you still have your phone... They probably would like it back before they do anything for you. Besides, why would you use a contract phone for what seems to be a pre-paid plan (unless you're over 65 - then Verizon has a senior citiczens plan that's arround $15/mo)
