Capitol One Bank/NCO/Silverman Law firm PC/and now Bleier & Cox LLP are currently making attempts to collect a debt that is now 8 years old, I am not sure how they have gotten a judgement rather I was never served any papers in 2008. I recieved a lot of threatning phone calls none the less. They contacted my neighbors as well served my neighbors with papers that I had received months after a court date was herd and set. My card limit was for $3000.00 and now the debt is $7,383.07? As well the debt was closed out and I paid taxes back in 2008/09 for Capitol One Bank. Now they have sent me a letter claiming they have a judgement and I better call them to fight it or they will do the following: garnish wages, lean on home, or levy against non exempt assets.

I would start by researching the judgment. Check with your clerk of courts. Now, your neighbors may be able to help you get it a vacate of judgment. Go to Debtorboards. They are a com. They give free advise. there are no sales etc. Now if they call you tape it. You need to catch them threatening you etc. Now National Association of consumer attorneys take cases on a contingency basics. Check on line for them. if you find there is no judgment then they lied. If you can prove it. You can collect money. I want you to know that NCO has a terrible record with the Federal trade commission. You may even want to file a complaint with your attorney general. File a complaint with FTC.Gov. They will not act on your complaint but when it happens to thousands. they file suit.
The attorney General of your state can help you. And the state where NCO resides. File a complaint in that state. Which I believe is PA. PA A.G. Office helped me.
The bottom line is research, and learn your rights. By the way I am not an attorney. this is friendly advise from what I went thru. Which an NACA attorney took care of because it was identity theft.
You need to read at debtorboards and study. Be proactive rather then reactive. Be ready to fight them. File motion to vacate due to faulty service. Your neighbors need to help you.

Most states have prejudgment interest rate and Post judgment interest rate. Keep that in mind. They also pay pennies on a dollar. You debt may be worth .10 on a dollar. The rest is profit. Remember research and investigate. keep your chin up and get a positive mental attitude that you can win this.
Remember find out about the judgment from the clerk of courts. Most states have non exempt property and Homestead laws to protect you. In other words liening your property means that
they can't just throw you out on the street. you get to keep some of your equity per state law or Federal law.
Get those phone calls on tape.
