In January of 2001, my wife and I purchased a home in Sun City Anthem at 1935 Sioux City Court. When we purchased our home from Del Webb, We were told that the trees behind our home would be maintained at no cost to us. When the chief sales representativees from Del Webb Mr James Bond,and others left their positions at Sun City Anthem, the tree trimming stopped all within one year. In June of 2005, David Bermen, Vice President of Sun City Anthem Community Association sent a memo to David Lee Hicks that Del Webb previously maintained the landscaping and topping of the trees behind our property. Mr Berman requested that Mr Hicks take a look at the situation and see if it was appropriate to continue to trim the trees on our property.
We were advised that the request was approved by the landscaping Department of Sun City Anthem around June 2005 and that we could trim all the trees that needed to be trimmed behind our home. We employed Do It Pro Maintenance to take care of our landscaping due to having cancer of the chest. Mr Wayne Weaver, sent a letter to Sun City Anthem, stating the trees were being trimmed correctly. We still have a copy of the letter. In August 2009, we received a letter from Ms Christine Noble of the Sun City Anthem Landscaping Department. Mr Doung Proudfit,from the local realty came to our home telling us that he was going to report this matter to Chistine Noble for board action. We reported to the Board and was found guilty of destruction of a living tree and were charged $ 6,800.00 fine. The legal fees were $ 2,500.00 with a refund of $951.00, doing the complete time my Attorney was telling us to drop the case that the HOA was very powerful. We know that if we would have continue with our case we would had won. We were also thinking that our neighbors had his trees trimmed by the same company and not one word was said to him. My wife and I, were thinking could it be because we are of color. My neighbors are of the white race and we are of color. We really don't want to think that we have racism in the Sun City Anthen Henderson, NV., however, that is the way it looks. We are only asking for our civil rights and justice in this case. Mr Jack Troia and the Board members are all white.
