i have worked at shoe stores before and although i know you feel you should get a refund, just think about it from their side. When i was a cashier i had over 20 people a day try to return worn shoes. You can tell by the bottom of the shoe if it has been worn outside. People will not buy shoes that have been worn buy other customers. If we return the 20 shoes that came in a day at an average of $50 each that would be a $1000 a day in shoes that we can not sell or stand by. It is also to prevent people who buy shoes for special occassions and having them return them the next day (prom, weddings, reunions, ect...) I have bought shoes from DSW before and it clearly says on the cash register that you cannot return worn shoes. Also, the company can log every return to the cashier that returned them so they cannot break policy or they will be written up/fired. Also think about it from a company stand point $1000 a day in returns is hundreds of thousands of dollars a year and then think about nationwide.... people get cut, low pay raises, and higher prices...take your pick

DSW as a company has spent millions revamping their return policy at the end of the last year. Currently, any shoe purchased through DSW may be returned. If the condition of the shoe is anything less than new it is filed as "Damaged" but this loss goes directly to the company, as you will receive store credit.

YOU are satisfied that they are OK for YOU. This proceedure is suggested to prevent wear to the outsoles, and wear to the outsoles will preclude your returning the shoes.....
Once you have put 'wear' on the outsoles, you own the shoes. The rash is unfortunate but presumably cannot be predicted, or warrantied against, by the store.
Try come cortisone cream on your feet.....
