My husband and I have faced serious problems with this collection agency based on the acts of our previous landlord and their collection practice.

Back in June 1 2009, my husband and I were forced to abandon our apartment at the Design Place in Miami, Florida based on a severe rodent and cockroach infestation. The Design Place was warned of the infestations and of our need to vacate the premises on previous occasions, including detailed letters and email both mailed and hand develiered to the adminsitration advising them of the situation. Said warnings were given a substantial time in advance, prior to vacating the premises since, although we had a year lease, said lease could be terminated after six months based on our prior agreements with the landlord. We were told that we would be allowed to vacate the property but our security deposit would be forfeited. In return, we would not be charged for the additional two months allegedly remaining on the lease. Hesistantly, we agreed to the same and subsequently confirmed our agreement in writing via a letter which was also mailed and hand delivered to the Design Place.

Now, some time after we left the premises, we are being contacted by this collection agencies regarding money allegedly owed to said company. Not only did we have to live in substandard conditions, but now we are actually being charged extra for finally abandoning them and taking all the proper steps in doing so. No money is owed to. The collection agency has forwarded us the documentation used to allegedly substantiate the collection process. Said documentation in the collection agency's possession includes our leasing contract and letters mailed to our old apartment address at the Design Place even after we had given notice that we had vacated the property and conducted the inspection. Needless to say, the documentation in this collection agency's possession is not sufficient to hold their claim for collection purposes. Nevertheless, the collection agency has made our living sitution extremely stressful by placing an additional hardship on us and destroying our credit. We have explained the situation over and over to them, but they refuse to let go until they have completely destroyed our credit without good cause.

Lawyer time

I think its about time you got a lawyer to handle this. If you have documentation signed by your landlord or the property  then i suggest you take them and the creditor to court and have them reinstate your credit by removing the so called debt. If you do not have the paperwork you said in your report,,, well then it's a  lot harder to prove that you actually gave notice. Did you take pictures of the apartment and the infestation in question. That will help a lawyer out alot in taking your landlord and the collecter to court

Any customers who have disputes with our company are given the opportunity to make this dispute in writing and provide documation as to the reasons why.

In a tenant situation if there isn't a walk thru report stating that the tenant has left the apartment in a free & clear condition, then we the Collection Agency will send the written dispute to the client to respond. If as in this case the negative report is not cleared it is because the client has validated the balance or charges as being due.

We have no outstanding disputes that have not been validated to our knowledge.

For future reference this tenant should know that if they have a complaint with the landlord they need to put it in writing and put the rent into an Escrow account, Til such time as the matter is resolved, This is a process that should take place "PRIOR" to collection .
