AFNI Collections are a scam. They will damage your credit report without giving you proof of debt. I think I've covered ALL of my basis with AFNI. They requested I pay on an account I never had. I sent them a certified letter to validate the debt or remove off my credit report. They answered with a generic printout that doesn't even match the amount they claim I owe. I sent them another certified letter demanding that the remove the debt from my credit report otherwise they were in violation under the Fair Credit Reporting Act. They again responded with the same generic printout. It's been 2 1/2 months since my first correspondence with them and I am ready file a claim now in small claims court for the maximum allowed fine of $1,000. The problem is that I am in Denver Colorado, they are in Illinois. What do I do?

Sue them.

Hire an attorney and sue them in District Court in Denver.

District court can award actual damages, statutory damages up to $1000, and reasonable attorney fees.

You shouldn't have any trouble finding an attorney to handle this for you -it's easy money for both of you.

My question is when you sent the certified letter did you do it with return receipt requested? Did you keep copies - These are important pieces to take to court Been there done that - In the State of Texas the Secretary of State requires that all debt collector must have a surety bond on file - if they do not, they cannot collect Check with your State to see if it is required for that is a BIG plus for you in court Good luck and take these scum bags down visit www.budhibbs.com for more information

Thanks everyone for the suggestions. I do have all my ducks in a row, so yes all the correspodence was sent via certified mail WITH return receipt. I did file a complaint with the attorney general's office in Illinois as well as in Colorado. I'm not sure what will come of that though. I'll start looking up some attorneys now. Thanks again
