I received a call from Asset Acceptance on behalf of Hurley State Bank on May 3, 2007, claiming I had an auto loan in 1988 in the amount of 24k and wanting to collecct. I have never had an auto loan with this bank and they, Asset Acceptance, had no other information. They told me to file a fraud case with the police but I have no information.

This has never appeared on my credit report to my knowledge and I will not pay them because they can show me no information. They have harrassed my wife on the phone telling her we had to pay this amount and if it was identity theft we need to file a claim with the local police.

#1 Consumer Suggestion

Adolph, They ARE NOT calling "on behalf" of the bank!

AUTHOR: Steve - Bradenton (U.S.A.)

Adolph,

Hurley State Bank is in no way involved here, guaranteed!

Asset Acceptance are JUNK DEBT BUYERS who purchased this old, uncollectable account for far less than a penny on the dollar.

The problem with these old "debts" is that they have little or no information on the actual debtor, in many cases not even a SS#.

That is why everyone with the same or similar name gets the same collection letter. They are fishing!

STAY OFF THE PHONE!! Never call, or speak to any debt collector on the phone! NEVER!!

DO NOT file ANY reports at all! These become public record, and then these lowlife can get information on you that they currently do not have. Then your signature could end up on a contract! DON'T DO IT!!

In this particular case, just ignore them. They can't do anything to you and they know it.

Go to ftc.gov and file a complaint online for the illegal/unethical collections activity.

Send a CEASE COMMUNICATIONS request as per your rights under the FDCPA. Send this by certified mail, return reciept requested and be sure to put the certified# on the letter itself and keep a copy for your records.

Now, when they violate this request, you sue them for up to $1000 in punitive damages as provided for under the FDCPA plus actual damages and costs.

Don't get mad, GET PAID!!
