NCO Portfolio Management - Capitol One The above company garnished my bank account in the amount of 307.05 today for a bill I know nothing about. I never had a Capitol One credit card and was never notified to the actions of the company. Pensylvania Internet

I was garnished in the amount of 307.05 today for a bill I know nothing about. I have never owned a Capitol One credit card and I am being garnished by the company for the above amount. I was never notified to the action and was never aware that this bill exsisted. I am hopeing to get some help in resolving this matter asap. They took my entire check and I am now in danger of losing my house because I cannot pay my rent.

Demand "proof of service"...And...

This is a common scam, especially with NCO. They engage in what is commonly known as "sewer service".

They knowingly "serve" a very old or totally bogus address with full knowledge that you will not actually get it and have a chance to respond. Then when you fail to respond to the summons and show up in court, they move for a default judgement.
Then they enforce the judgement with garnishment, etc.

You need to go to BOTH your bank and the court clerk of the jurisdiction of where you live.

DEMAND from your bank copies of all correspondence that authorized them to take your funds under garnishment.

Got to your clerk of court and ask for copies of ALL paperwork filed in the case from day one, which will include the original summons and proof of service, along with affidavits and the like.

Carefully examine the "proof of service" document. This is where you nail them. If the service address listed is not your current address, you have them.

Be sure to file Bar Association complaints against all lawyers involved for the unethical and illegal activity.

It is a felony in most states to file a false document with the court, or to make a false statement.

Nail them to the wall!!

Also, you can sue them for any damages you suffered from the illegal garnishment.

Look for a lawyer right away!!

Amazing lawyers

Incredible lawyers would be a party to such antics - filing bogus paperwork for NCO & taking your cashola - zip, zap that easy.

Well guess I shouldn't be too surprised as NCO seemed to have hired/engaged the services of Hunt & Enriques, a firm in San Jose, to let their phone robot chase after me regarding a debt that's 20+ years old. Yep, got 1-2 weekly calls but who bothers returning robot calls.

In my case I contacted the AG in PA (NCOs home state) and the matter was investigated and the H&H robot was soon turned off. Yah!

Hopefully NCO will go the way of Camco, the address that company had for me was well over 30-40 years old. Geesh. That's the best they can do? Even old girl friends have better luck than that.

All collection agencies have a new trick know

All collection agencies have a new trick know. They place collection accounts without you even knowing about It or before they mail you a collection letter.

They do this know because they can't take It off!. This Is a knew trick the bottome feeders are doing.

After you complain they send you a collection letter. I thought It was buy law collection agencies are suppose to write you first giving you 30 day's to dispute the dept.

Know they are placing collection account's without the person knowing. I thought I should warn people, check your credit report.

Because If you don't you may have 20 or more collection account's on your credit report because they don't notifie you In the first place.

They are violating the fair dept credit reporting act. All collection agencies are doing this they don't even verifie If the dept belongs to the correct person.

They just go ahead & place It on your credit report without your knowledge. They are messing with your life & trying to ruin you!.

That's all these bottom feeder's care about Is to ruin you even If the dept. Isn't yours.
