Portfolio Recovery Sears account off in 2001. Balance $385.00. per Portfolio, phone calls. Lies, Hutchinson Kansas

I paid my Sears account off in 2001. We turned the card back in. I started getting phone calls last month, October,2006.
A Mrs. Payton from Portfolio claims we still owe $385 on the account. This is a lie. This account was definately paid off.
She insisted that we only made a $30 payment in 2001. The $385 was a chainsaw that I bought and paid off nearly 6 years ago.
We returned her first call and left a message on her voice mail. She claims she didn't get it. She called again. We returned her call again.
The man answering the phone didn't even know her. Through some bantering she called us back again.
She claimed the same and we owe the money and did we have proof. That was nearly 6 years ago. My question to her was why didn't Sears call us and tell us we owed the money 6 years ago.
No one that I know of keeps record of this kind for 6 years. We will have to dig through records to prove we don't owe the money. This is really strange.

They have to prove you indeed owe it. Do not give them any information. Since they allegedly have information that you owe money, then they would have your address.
Since they will be calling one more time, tell them to send you verification of the debt and you will answer their validation by certified mail accordingly.
Then you can take it from that point using suggestions from others on this site.
I don't believe you'll be receiving anything in the mail though.

The burden of proof is on them. And they know it!
You never have to prove that you don't owe the money. And, you should NEVER speak to any debt collector on the phone. NEVER!!
Just send a DEBT VALIDATION request where you clearly dispute the debt, and demand a full account history and itemization of charges. Send this by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important.
Also state that phone calls are no longer acceptable and everything must be in writing.
They should go away after you do this. Here is the contact info:

I wish to thank all for information. I composed a letter today to the Corporate offices requesting an itemized account report and asking for proof that I owe this bill.
I told them no more phone conversations period.
Vicky(?),(was Ms. Payton) from Portfolio called today wanting to know if I received the letter she wrote. I told her " No more phone conversations on this matter" and hung up. Thanks again.

That's exactly how calls from debt collectors are to be handled!
I'm glad someone finally figured out how to STAY OFF THE PHONE!
If everyone did this, the abuse by debt collectors and junk debt buyers would cease, as they would have nobody to talk to!
And they surely won't put that illegal garbage in writing.

the laws regarding collections are so lax here. If you have a problem with the office located in Kansas, PLEASE find a complaint with the AG's office. The present AG might not do anything, but the one just elected might.

As of today, things are in limbo. I wrote the letter to the corporate offices and sent it registered with return receipt.I again wish to thank you all for your valuable input and suggestions. I will keep updating as necessary.
Talk about criminals in our midst!!! They actually pay folks to lie and cheat(steal from, actually) others without any misgivings what so ever.
