Stuart Allen & Associates ripoff, Collection Agency FRAUDULENTLY reported to credit agency that I owed money Tucson Arizona

My credit has been adversely affected by STUART ALLEN & ASSOCIATES of Tucson, AZ when they FRAUDULENTLY reported to credit bureaus that I owed their client money. There was never any judgment or valid claim to money owed.
They just said you owe us money, never offered up any proof, but this collection agency managed to get it on my credit as a negative mark, even though my attorney fought it all the way and demanded they show cause or some justification for the demand for money.
I have filed a FTC complaint against the collection agency thus far. I believe this is a violation of FDCRA, we'll see.

Im sorry to bring this up but I found a few issues in your complaint. I am a former employee of Stuart Allan & Associates as well as a former debtor. I found no issues when dealing with my own debts, however I am more concerned about what I saw working there. First off, Brian, I think you were referring to the FDCPA aka. Fair Debt Collection Practices Act. I have never heard of a FDCRA.
Second, it sounds like you may be blaming the wrong source. When a client reports a debt to a collection agency, it is up to that agency to collect it. Now Im not sure if this was a commercial debt or a personal one, but I do know that they send out automated statements to debtors so as long as you gave them your address, you would have had your proof.
I cant help much with the shady information you've provided, but I can say that maybe you should read up on the FDCPA and also simply request documentation from Stuart Allan & Associates. It sounds like you're just angry and not really researching this thoroughly, which I encourage you to do, as anyone who ever owes a debt should do.
The FDCPA does protect debtors but it also protects third party collection agencies from people walking away from valid debts.
In my time at Stuart Allan & Associates, I saw a lot of disgruntled people walk through the doors, but generally when they were calm and professional, they walked out with what they needed as proof, if not satisified since they handled the debt. Out of any collection agency I have ever been around or had to deal with, this one keeps their paperwork in order and stays within guidelines very well.

I have to comment on this report. Stuart Allen ex employee states that the FDCRA is something she never heard of - it is the Fair Debt Collections Reporting Agency. It is an agency that people can contact to help them if they feel they are the victim of unfair debt collection practices. While this ex-employee may have been acting under the proper FDCRA guidelines I know personally this company does act out of compliance with the FDCPA - you can see what they have done to me on my own ripoffreport, which i will be writing as soon as i post this.

First of all, there is no such thing as the "Fair Debt Collections Reporting Agency"
It simply does not exist.
The FTC governs both the FCRA and the FDCPA.
1. Fair Credit Reporting Act.
2. Fair Debt Collections Practices Act.
The FTC does NOT do enforcement on an individual basis.
Individuals MUST sue in court for damages under either of these acts.

Sorry to have to correct this, but there's no such thing as the "FDCRA". It's the FDCPA. The FDCPA is a law.
