I was contacted first by UCB by a message left on my answering maching advising that they are attempting to contact a neighbor and his wife regarding a pending legal case. They left the customers name, address and case number and asked that I contact them immediately and/or leave them a note to contact the company. Shortly thereafter, my 17 year daughter came home and received a call from the company. The lady got very upset with her that she did not know who this neighbor was. Later in the afternoon, my husband received a call where the man was very unreasonable. When I got home and got the different stories from the family and played the message several times-I called the company and advised them that if they wanted to take the appropriate action-then file a legal case or contact them by mail. It is not the neighbor's responsibility to be a collection agency. He advised that me that if I choose not to contact the neighbor that was my business, but in the meantime they were going to continue to call.
It would be very embarrasing for the neighbor, if I went over and told them this company was contacting all theri neighbors. Although these folks have made me so angry, I would like to file some type of claim against them.
They got my name from a neighboorhood search and online phone look up. I changed my name several years ago, but the phone company has not updated the phone listing. I am okay with that if people like this call.

What else can I do to take actions?

Advise...

Send a letter via Registered Mail with Return Receipt stating the following:

Per the Fair Debt Collection Act you are to cease communication with me about my neighbor's debt. If you continue to call I will file charges with the Attorney General of your state for Fair Debt Collection Act violations.

You need to communicate with your neighbor. If he/she doesn't communicate with this firm, they'll continue to harass you.

I would think that at this point you've got a stalking/harrassment case. File complaints with the entities mentioned in the above rebuttal, as well as your local prosecutor's office.

Somebody also has an FDCPA claim. I don't know if you have standing under the FDCPA because you are not the debtor. But your neighbor seems to have an FDCPA claim. You should let them know what's going on and advise them to find an attorney.

FDCPA and information/locating

Per the FDCPA they can contact anyone besides the debtor if they are trying to locate the debtor. However, the FDCPA is very specific in that they can contact you ONCE!!!

MOre than that is a violation. Further, because you have already told them that you will not be their agent, any further contact by them is deliberate harassment. Not only is this harassment a violation of the FDCPA, it is criminal in almost all US jurisdictions and you should file an appropriate criminal complaint with your county district attorney's office.

You can read the Fair Debt Collection Practices Act at ftc.gov/os/statutes/fdcpa/fdcpact.htm

Section 804 Acquisition of location information. This is the section that states they may contact you ONCE!!! You might point this out to them the next time they call.

Section 806 Harassment or abuse. This outlines what is a violation of the FDCPA as far as deliberate harassment.

In this case they are allowed to call your neighbors and try to get in contact with you. In this case at some point there is two sides to every story. No it is not against the law. If you know the law instead of the liquor store antics that people send to you understand that what we do is not proper. Instead of blowing all of your bills off and not paying them until income tax time, and make arrangements maybe then you wont have the problem. But on the other hand as a collector we are allowed to contact your neighbors once every thirty days no laws says that we cant.
