In a recent review of my credit bureau report, I noticed that this collection account had been included in my report for some 1200 for an alleged outstanding debt owed to Capella University. Interestingly, education expenses have been solely through student loans. Also, this company is in direct violation of the FDCPA. Never received any notification of an alleged debt, which by law, I am entitled to challenge any alleged outstanding debt prior to collection action. This opportunity was never afforded to me and this company simply chose to report derogatory information in my credit bureau files.

They violated FDCPA and Fair credit reporting act

Bottomfeeders

www.budhibbs.com - excellent resource for fighting debt collectors like this.

You can sue them for adding that to your credit reports

Of they never sent anything, its counterproductive to their ripoff scam to let you in advance. They probably are not lawyers either

NEVER SPEAK TO THEM ON THE PHONE! GET AN ADDRESS AND SEND MAIL CERTIFIED RETURN RECEIPT.

Double Check credit report

AUTHOR: Life - Ames (U.S.A.)

DD, You might want to double check your credit report. More than likely DCS did an inquiry on you, possibly to obtain your address or phone number, perhaps you failed to keep that information updated after you left college. DCS is a collection agency and will do what they need to do to try and find you. I would think since you have probably moved a few times since leaving school your current address is probably not on file. As a collection agency they would have sent a letter of notification to the last address you provided, giving you 30 days to respond. You are correct in stating that you only took out student loans, thats exactly what this is, a defaulted student loan. DCS is the collection agency retained by either the Dept of ED or a state agency to get you set up on a repayment program. Also, DCS cant report anything to a Credit Bureau, they dont own the loan and you dont owe them, at best they could do an inquiry. I dont see where they violated FDCPA. Im sorry but I dont see the 'rip-off' either.

ANOTHER BOTTOM FEEDER RESPONDS

AUTHOR: Laurie - Haslet (U.S.A.)

Don't listen to the fool who claims it was only a check and not bad info posted

DCS is junk debt buyer, they buy debt that is not legally collectible for pennies on the dollar and try to harrass or scare you into making payments on a debt that is not yours.

Check your student loans with the original creditor too.

It could be they have made you responsible for someone else's debt.

Another FOOL responds

AUTHOR: Life - Ames (U.S.A.)

Dont listen to Laurie, she obviously doesnt know what she is talking about... she doesnt even know where she lives, in one post she states she lives in San Angelo (one of DCS's company sites... hmmmmm) and in this post she states she lives in Haslett, very confused Laurie if you ask me. But, I digress... and as for DCS 'buying' junk debt, DCS doesnt 'buy' anything, they are a collection agency 'RETAINED' by the entity that owns the debt, there is a BIG difference.

to Life

AUTHOR: Laurie - Haslet (U.S.A.)

I have never had another city other than Haslet listed in my profile. I have never mis-represented myself as an expert just referred them to EXPERTS.

Based on your comments - you work for this collection agency.
