Subject: Gateway / Hurley State Bank

Purchased a Remanufactured SL 9150 BTS PC 3 on
01/25/00 at;

Gateway Order # 43891954, Invoice # 3830304, Sales Rep
1035888
Client Pick-Up
101 Gateway Drive
214 North Derby Lane
North Sioux City SD 57049

The total cost was $2282.18

The computer was returned: because the SL 9150 BTS PC3
did not have / would not retain two applications;
Active X / DirectDraw (the computer did not function
from the date of purchase).

This meant, that the DVD player could not play DVDs or
play certain graphics.

Besides "losing" these two applications after
down-loading Microsoft security patches / up-dates;
other applications became "missing". E.G

application commands (the icons), to include the icon
for the entire application. Then there was the
"losing" of .EXE, .VMD, .VMX file extensions
(blue screen of death).

After the 5th time (keep in mind, this laptop was
purchased to run a accounting program for OTD trucking
/ IRS). I returned the computer.

The Remanufactured SL 9150 BTS PC 3 Laptop computer
was returned using FedEX Air (FedEX Tracking Number
820134213250 / paid using VISA) on 24 May 00 from the
Cleveland Hopkins Air Terminal. It was recieved and
signed for by Gateway.

On 29 Jan 04, I called Credit 1, who claims I now owe
$4228.46 as of that date. This "Charge Account" has
been "purchased" from CitiCard / CitiBank (06/03/2003)
who purchased it from Hurley State Bank (perhaps
others). I'm still chasing down just how many States
/ Creditors this "debit" has past thru.

You see, Gateway will not issue a "credit" for the
returned computer because, "it was an unauthorised
return" (remember, for a non functioning computer,
that didn't function from the date of purchase)

And when Hurley State Bank held the "note" (Account # 6011767401575715), Gateway wouldn't issue the "credit" because it was sent to the wrong address. ( I wonder how much "bad debt" / bad merchanitise sales, Gateway has "floated" / hid using
this technique.)

Today, I called Gateway to resolve the issue (ref #
2-1383634305). I talked to a Concheaka (badge# 660).
The conversation went from "we have no record of
speaking to you..." to "... there is missing
documentation... / ...that documentation doesn't
exist...".

I kept notes of what went on, I called Gateway when
Hurley State Bank held the note and I talked to a
Jessica and then a supervisor at Ex 7406. They first
denied that I sent the computer to them (I sent it to
Gateway 610 Gateway Drive, North Sioux City SD 57049:
the I address I was told to, ..."send it to the
address on the box that it came in"...). Then, Gateway
said it was sent to the wrong address; then the return
was "unauthorised".

One suggestion: DO NOT BUY A GATEWAY COMPUTER nor USE
THE SERVICES OF HURLEY STATE BANK....

PS This information will be forwarded to the
respective State Attorney

Generals of the different states / CPB's that this
account has passed through.
