Esolz Esolz Technologies Breach Of Contract, No refund Kolkata, Other

Esolz accepted a project on scriptlance, signed a non disclosure and a contract for the project, the contract included a deadline, that the programmer had knowledge to do the project, and the software and hardware to do the work.

Deadline initially was 7 months, after a few agreed upon extentions, there was 1 final deadline given however, after that deadline was given we were concerned about the progress of the work which was stated at 70% by Esolz. We had a 3rd party review the work completed thus far. After 11 months of work the project was evaluated to be at 30% complete, with MAJOR issues including to list the most important, NOT cross browser compatible on any web page, NOT secure as all forms inputs provided security risks. This proved that Esolz did not have the experience to complete the project, during the project Esolz required us to purchase a server to work on which proves they did not have the hardware to complete the project. The deadline even proposed could not be met with only 30% completed after nearly a year.

They are an international company and as such the only way to successfully sue is to gain legal representation in India to sue which at this time we are doing. The contract clearly stated that if a breach occured as shown with factual evidence has occured that all and any funds be returned.

Their response to this is simply you gave us 2 months extension we are not in breach which entirely negates / ignores the facts about the actual breach of contract.

They have refused a refund as per the contract and as such I am pursuing legal action.
