I filed my case against the CTTT (Consumer Trader and Tenancy Tribunal) and the first judgement was in their favour as I had nothing in written. But then I have done a thorough homework this time.

I am going to appeal the first judgement of the court and demand another hearing.

I am going to make a presentation which shows how they deceive their customers. I still have the software and they have left on little kink which is easily accessible by me (as I have tried to work heaps on the software) and can be shown in the court of Law.

I live in Sydney and need witnesses in the court who have been doomed by the same company...As one of the complaints of a consumer suggests, I also met their sales rep in the Westfield Shopping Centre of Parramatta and was given a glimpse of totally misleading win figures on their software screen.

Basically I have a plan this time (honest one as I don't lie and need JUSTICE). I do not want this to happen to other people's hard earned money. I will make sure that ACCC gets the complaint and I write letters to the media etc. I am full confident that I will win because this time I will expose their misleading software.

I have unfortunately had a same experience with this company. I just wished I could have found this website before buying the product.

What was particularly shocking was that we both got introduced by this company at the same place, Westfield Shopping Centre at Parramatta.

I have learnt a very bitter lesson through this experience.

They told me that if I don't like the product then I can ask for a refund during the training sessions and the sales rep kept silent at this. They showed me misleading figures on their computer software and told me that it was their profits for the day, which was just a software output and not real time profits.

Basically, I have lodged a case with the COnsumer Tribunal as they are now refusing to give me any refund; they now say that their sales rep had explained to me that the refund was only obtainable during the first three training sessions and not after that (what a big lie!)...They never explained this to me.

Now I didn't have anything in written to prove this so the first hearing went into their favour. I am going to appeal the courts decision and would like to know-

If you could meet up with me and come with me as a witness? WE HAVE GOT TO STOP THEM FROM MISLEADING OTHERS.

I was so confident that I would win the case when I appealed for it, but unfortunately they rejected my appeal request. The judge during the first hearing of the case didn't see anything my side for some reason. I felt I didn't get justice and the other party's word was taken over my word due to total lack of written evidence of the refund policy that they had explained to me verbally.

The judge has asked me to resell the software and the Nu-Tech people have been asked to help train the person I sell the software to.

I was given only two option by the judge, to either try and resell the software or just use it myself and be happy with it. No other options...At the end of the day I said I actually have no other option but to choose to resell the software. The judge then wrote something, the other party left laughing and I was left crying. I am so so disappointed that the judge took their word over my word.

When I applied for an appeal I got reply for them that I cannot appeal because the judgement in the previous hearing was taken with my consent (I was shocked, as one can imagine). It seems that because I was helpless to choose one of the options out of the two options that the judge had given me, I had consented to a judgement and thus I cannot appeal no matter how much more evidence I have accumulated.

My $17,000 went down the drain...Goodness, why didn't I read this article of yours before I purchased it? All my curses to those people who run this business of ripping others off their hard earned money.

I don't even want to resell it to any other person and accumulate the bad karma...what can I say now. A lesson learnt a hard way; a $17,000 lesson that will haunt me all my life.

I feel for all of you i got scammed the same way cohen strachan investment for $17,600 and i luckily kept all my documents and even had a solicitor witnessed everything and thats why i have won my case because of the precautions i took and right now im in the process of bringing them to court to get a financial hearing on there assets so the court can see how and which way there going to pay my money back. but i do feel for you and with any luck there can be more policing going around to stop these people.
