Orbsoft, Inc. did not deliver a guaranteed piece of software to Excel Sports Science, Inc.

On November 18, 2004, CEO, of Orbsoft, Inc. sent Webmaster, of Excel Sports Science, Inc. the following email correspondence:

Hello,
I can confirm that your server meets the installation requirements. The installation is guaranteed.
Please find invoice attached.
When should I expect to receive payment?
Thank you

That day our Controller mailed a check for $695.00 for software created by Orbsoft called "XIProx". Meanwhile, Webmaster replied to CEO of Orbsoft with the following email communication:

Great. We are cutting the check right now, and sending it priority. It should be in Pasadena the day after tomorrow.

To which CEO of Orbsoft replied:
That's great news.
(Comment: This must be great news for him as he seemed very experienced at ripping others off)
Thanks so much.

That was the last communication Excel Sports Science, Inc. received from this CEO or Orbsoft, Inc.

Weeks later after waiting for a reply, Excel Sports Science discovered that the check for $695.00 had been cashed and cleared by December 1, 2004.

After waiting over 1 month, Owner of Excel Sports Science, Inc. Issued an email requesting that Orbsoft refund the company's $695.00 for undelivered software.

To this date, Feb/08 2005, Orbsoft, Inc. still has not responded.

Excel Sports Science, Inc. would like Orbsoft, Inc. to refund in full $695.00 for undelivered product.

Xiprox (or ZIProx): Web based software to locate dealers by zip code. This is the ficticious software in question.
