In March 2007, I purchased a "customized" DVD of the Los Angeles Marathon for over $100 from DVD Marathon, a.k.a. DVD Productions, LLC. They had a couple of booths set up at the LA Marathon Quality of Life Expo, and appeared to be a legitimate company.

According to the company, it takes 6-8 weeks for the order to ship after the marathon. On March 8, 2007, only a few days after the marathon, I received an email from "stephen@dvdmarathon.com" acknowledging my completion of the marathon, confirming the order, and offering a preview of what the DVD would look like. I thought all was well.

A few weeks later, on May 23, 2007, I received an email from the company stating:

"Dear Customer,

We apologize for the further delay.

We are dealing with some technical issues and are doing our best to ship your order as soon as possible.
Your Los Angeles Marathon DVD is now scheduled to be shipped on June 7, 2007.
Please allow an additional 8-10 business days for USPS media mail delivery.
We appreciate your patience."

This was the last I ever heard from the company. The DVD never arrived. I began making efforts to contact the company. Three times I have called the toll-free number for the company, (888) 263-2690 -- which is nothing more than an answering service -- and all three times I have received no return call from anyone.

I have attempted to reach the company via their web contact form at least twice, but I have never received a response. Today, August 23, 2007, I attempted several times to submit another inquiry via their web form, but this time I got an error message.

I attempted to respond to the email I received from stephen@dvdmarathon.com, but I received an automated response stating that he has a spam blocker, and that I must be an approved sender in order to send him an email. I filled out the form to obtain permission to be an approved sender, but when I clicked "submit," this also returned nothing more than an error message.

It is my view that this company is a total fraud, and is violating Section 17200 of the California Business & Professions Code. It is engaging in false, unfair, misleading and deceptive acts, advertising, and business practices, by taking consumers' hard-earned money for goods and services that it does not deliver and has no intention of delivering.

In my view, the LA Attorney's office should investigate and shut this operation down, and take criminal action against the principals. I am personally considering my options, which range from merely disputing the credit card charge (it may be a little late in the day for that), filing a small claims court action, or locating some others like me to potentially bring a class action lawsuit against the company (to obtain force them to give restitution).

In addition, I believe that the organizers of the LA Marathon should take some action against the company, including: (1) prohibiting them from obtaining business from future marathon participants; and (2) issuing a warning to all future marathon participants that they may get ripped off by DVD Marathon.

In my frustration, I did some research on the Internet, and found that the company had done a similar thing to consumers with respect to the Las Vegas Marathon in December 2006.

The bottom line is that this company is a total fraud. $100 may not seem like a lot of money to lose, but that is not the point. Do not do business with this company under any circumstances.

I'm One Of The Many Who Never Received The DVD Ordered

Like yourself, I also ordered a DVD from this firm. When the middle of May came and I hadn't received it, I e-mailed the company and got about the same message you did. In my case, I was told to allow another 18 days. Since that time, I've gotten more excuses and lies.

I called the LA Marathon and spoke to John Wilson who gave me Mr. Grudenic's cell phone number. Mr. Grudenick blamed a computer crash on the problem and said that they should go out by June 16 - via media mail no less which is the cheapest way to ship. If I was a reputable businessman, I would ship it out priority to at least make up for the delay in production; but not this guy. And by the way. His cell phone is now programmed to ring unfamiliar numbers to his message center which Mr. Wilson said is understandable since he's given the number out to the many who have called him.

One thing I've found out, is that when you e-mail for an update, they usually answer you but when you mention the words "please cancel my order and credit my credit card," then they don't. Or if they do, they ignore that part and again say there's been a delay in shipping.

In July, I was so mad that I left a message for Mr. Grudenick and told him that if he didn't call me by the end of the next business day, I would contact the FTC and the State Attorney General. He did call me and swore that it had gone out the previous week. I never received it and he didn't return my calls to talk about a credit.

I was only in for $60, but I disputed this with my credit card company and I've written the BBB (who wrote him two letters of which he didn't respond to), the California State Attorney General, the LA County District Attorney's Office and lastly, the Postal Inspector as I was told by an investigator at the District Attorney's Office that what he's done is commit mail fraud.

I left one more message for Mr. Grudenick and told his message center that I've written the Postal Inspector and reported him for mail fraud. He called me the following business day and swore that it had been shipped to me 45 days previously. He also showed what a bad businessman he was when he said he received the letter from the State Attorney General's office and from my credit card company giving him 60 days to answer the dispute. He told me point blank that he wasn't going to answer the letter from my credit card company as they would "automatically" credit my card at the end of the 60 days! So why should he bother answering it? He said he wasn't going to fight it and hasn't fought others either who disputed their charges.

My advice is to dispute this with your credit card company as I did and explain the background. Mr. Grudenick says he's not fighting the charges. If he says your DVD was shipped, let him prove it! I doubt if he can.

And by the way, Mr. Wilson of the LA Marathon told me that he's received dozens of calls from people who never received theirs either. Also, he's not about to do anymore business with this firm as "they've been a major embarrassment to them."
