KIS Country Club And Golf Academy Not honoring contract terms, Nashville Tennessee (Headquarter), Durham North Carolina

Joined KIS Country Club and Golf Academy, Durham, North Carolina, location on May 8, 2008. The membership package purchased was the gold package which included the following:

2 sets of Golf Clubs (clubs, head covers and bags) with lifetime warranty and replacement;

Unlimited Lifetime golf lessons (with Golf Pro);

Use of the Durham academy (based on location and convenience) which

included:

Golf Simulators

Putting Range

Play N Stay package - which included discounts on the following:

Worldwide Resort Vacations

Cruise Vacations

Golf Vacations

All-inclusive vacations

Scuba Diving Vacations

Hotel Chains

Car Rentals

Hot Deals

Immediately upon activating our membership, we started taking golf lessons. Within several weeks of twice weekly lessons at the Durham location, it was obvious that business was declining. This observation promtpted several members, myself included, to pose the question to Kis Golf staff about a scenario in which the Durham location for Kis Golf was closed for financial and/or poor membership reasons.

This question was never definitively answered by Kis Golf staff. Subsequently, approximately November 13, 2008, I received a phone call from the Golf Pro asking if I knew where he could get a job because the last few checks that he had received from this company had bounced. He stated that, "GE Money the finance company they were using for the new members to finance the memberships were behind in paying KIS Golf the loans for their new memberships so they have not been able to pay their employees."

Then we started receiving emails from other members about this and then we looked on the website and found out that they closed. As evidenced by the numerous e-mails received from other Kis Golf members, it was obvious that Kis Golf vacated and abandoned the Durham location. We also have some contacts at the mall location where they were and to our understanding is that they walked out the back door without any notice.

According to Kis Golf main website, Kis Golf will be opening a new location in Raleigh, North Carolina. This information is received with severe skepticism as it is the memberships understanding that all (Greensboro, Concord and Durham) Kis Golf locations have been closed, vacated and abandoned.

To date, I have paid two payments of $150.00 ($300.00 total) towards the $9,515.00 that was financed thru GE Money (see above acount information). Due to this material breach of contract, I am requesting that Troy and Valerie Hopkins be completely released of all remaining financial obligations (approximately $9215.00) to either Kis Golf and/or GE Money.

In November 18, 2008, the company filed for reorganization under Chapter 11 of the federal Bankruptcy Act, case number 3:08-bk-10809. This permits the company to continue to operate with court supervision while developing a plan of reorganization. Those with monetary claims against the company are advised to obtain a Proof of Claim form by writing to Tennessee Middle Bankruptcy Court CM/ECF, 701 Broadway, Room 160, Nashville, TN, 37203 for resubmission to that court. The case number should be entered on the form.
