Received an advertisement link on my outlook express. I thought I deleted the advertisement. Two weeks later I noticed a strange icon on my desktop. I clicked it on and found the site that I thought I had deleted. I clicked on one of the pictures and noticed that it automatically dialed a number through my modem, unauthorized by me. I noticed a button, "do not accept" and hit it. I received a statement one week later from Alyon Technologies, Inc for $152.00 I wrote back the following letter: "I believe that a communication error has been made on my unapproved charges. Your Internet Website icon appeared on my Desktop through deceptive programming through unauthorized Spam e-mail or linked advertising. FACT: 1. I did not get the opportunity to agree to any terms and conditions of the dialer and did not click the "I agree box". 2. I cannot be bound by your terms of use agreement as I did not "Agree" or sign up to the charges. 3. No permission was given to allow any charges to be made on my behalf, no charges were posted in advance of usage. 4. Your type of system uses software that installs object code format in order to access unauthorized services which has an "always connected" capability, based on unlawful applicable laws and regulations. I feel that you are in violation of deceptive practices of trapping the user without advance notice of charges. 5. This user did not approve the means of setting up an icon on my desktop on this form of unedited material which are sexually explicit. 6. The user has no control over and cannot accept responsibility of activating your icon. Consideration be given to cancel these charges on this account and wave any charges. This user reserves the right to confer legal counsel to be selected in any such defense or class action litigation." Yours truly, Answer to my letter: Dear: We have received your correspondence. Alyon cannot generate a bill without a connecting call received at our switch site in Union City, NJ. Once a call is received our billing system tracks the phone number and the person responsible for that phone number. A call cannot be placed without the dialer having been downloaded. For verification of Alyon's charges, please refer to the long distance portion of your phone bill. If charges to union City, N.J. (area code 201) appear on that bill on the same dates and times as listed on Alyon's bill, then that is third party proof the connection calls were placed from your phone line. Etc. My question now is how do I respond to this (censored).? Should I be concerned about my credit rating if I do not pay these charges? I did get a charge from my long distance service for $6.00 I maintain that I did not have the choice to get advance warning of any charges. Is there any attorneys out there that may use this as a counter suit or class action suit? Look forward to your help. Jerry 32779, Florida U.S.A.
