I became disabled in 2005 and now have only SS disability as an income.

My car was repossessed during my waiting period. They sold my car for 3800. even though it was worth 6800. Now they want the difference.

Social security checks cannot be garnished. I told the collection agency they hired that I barely make enough to live on,but they continue to call and harass me for the remainder.

I have now got caller ID that comes up on my TV. I don't answer if it is any number or name I don't recongize. This is wrong that they expect me to pay for a car that I no longer own. This practice needs to be changed. They should get top dollar at the auto auction instead of trying to get it from those who don't have the car or the money.

Capitol One CANNOT do anything

Since your on Social Security and retired, NOBODY can garnish your check. In essence even if the collection agency does sue they can never collect because you are judgment proof unless you have assets they can go after and place a lien on.  If not, nothing to worry about they will not throw away money in a lawsuit when they know they can never collect at all.

1.) Write a letter a cease and desist not to call you again, certify the letter.

2.) Change that phone number to an unlisted one, NEVER give it out to creditors of any kind. It is your right to privacy and your right to even have a telephone in the first place.
