Debra? What does your husband being in the Military have to do with you honoring your obligations? NOTHING! Does that or SHOULD that exempt you from your responsiblities? And I am sorry but if you breached the contract (and according to what I read - you did.) Then Yes Ma'am...you stole that car. It isnt yours anymore. Ask around and get someone to explain to you how loans and collateral work. The only thing that is wrong here is that the consumer should have to pass some sort of aptitude test or IQ test before being allowed to sign on the dotted line.

First of all I did not say it took away obligations for any debt incurred, and I do not think that this is a place to try to downgrade people because of anything they say. I was merely stating that we are a military family and there fore we can not control the fact that we had to move, that in no way should classify as theft of a car. You say that if it were a loan on a car that it would be the same, well that is not true, they do not tell you that you can not move out of the state where you lived when you got the loan in the first place. If that were the case there would be noone hardly purchasing anything what so ever. This matter was paid in full!!!!! And it was not the paying of the debt that I was referring to so maybe you should read more closely before posting something as degrading as you did to what I had said. It had to do with the harrassment, and to do with the fact that just because we were transferred to another state they wanted to press charges against me for auto theft which is not legal. My husband is an MP and I do believe he knows laws such as this.

First I'd like to say, Debra, I am sorry about your loss.

I have read and reread your report and am wondering if you took the time to read the contract you signed before you signed it and accepted the check. The contract states that what you signed was a "pawn contract" and is only valid in 30 incriments per Georgia law. It also states that that regardless of what state you live in you and the vehicle are governed by Georgia pawn laws (that is where the pawn was started and the contract was signed). As far as you "stealing" the car...the law that applies here is "Theft by deception" which means you decieved the lender by signing a contract stating you would pay back the loan and failed to do so per the requirements of your contract. If you knew you were moving then you probably should have made arrangements to pay off the pawn before you moved.

I am also wondering what you did with the "volentary payback guide" you signed and were given a copy of before you accepted the check. The "payback guide' is the paper you got showing what the interest payment was and how much was suggested you pay to apply money to your principal and repay your loan in a timely manner. As it is not our pollicy to want these type loans to drag out forever (it's bad for business).

Again you are governed by Georga (because that's where the monies were borrowed and the contract signed) as far as collection proceedings. In Georgia we can attempt to contact you as many times in a day as needed until we reach you and you hold up to your contractual obligations. By not returning phone calls and you left them with no other choice but to contact you references.

I am at a loss about how they would "keep adding so much to your account". Unless you are referring to the intrest that accumulates every 30 days or the prorated interest for days uncontracted. Your contract clearly states that because the nature of the pawn that there is no grace period and can only be renewed or extended by making the minimum interest payment. Payments cannot be doubled up. The excess amount over the interest due would be applied to the princapal and the interest due would be reduced which should make it easier to pay off the pawn.

In regards to one of your payments being $6.00 short. What would you have wanted the store manager do? Take the money out of their own pocket? You are already late on the pawn what was thier guarentee that they would get that money back?

I am very familiar with Mr. Young and TitleMax, as well as the company beginnings.

I would like to first say that if Kristie and Ellyssa work for TitleMax, then shame on them and I have forwarded comments to Savannah.
Mr. Young is a reputable gentleman/businessman and actually has one of the best Title Pawn companies. I've heard worse stories concerning other companies.

I don't necessarily agree with the repayment structures, but if the contract was agreed to, by the customer, then it is binding and should be adheared to. TitleMax isn't a traditional loan or financial organization, so it shouldn't be treated as such.

I too found myself looking at this financial hardship solution and seriously considered TitleMax, but was able to find an alternate means of financial help.

I won't deal with the title pawn business in general, until Georgia decides to put stiff regulation in place.

If I am in dire financial hardship and have to utilize a company like TitleMax, then I will do what's needed to meet the contract terms and not lose anymore money, since I put myself in that situation.

Anyway, we live and learn.

You may sit on your horse, high and mighty, making fun of other people, but your time will come. I agree that you must work for Titlemax because your comments are just like the information and run-around you are given when you try to contact someone at Titlemax to help you.

Apparently you failed to actually read the comment completly! I did not say I was six dollars short, I stated that the payment due was merely six dollars that they were harrassing me about. And when you are dealing with a death wiring six dollars is hardly on your mind. As for the rest of your comment, yes I read the contract to assume I did not would be assuming I was an idiot! Clearly you do work for this company that abuses their customers to no ends. Thank goodness it has been cleared up for over a year now and no I will never get another title loan as long as I live. But for you to respond the way you did is clearly rude of you to begin with considering your failure to read all statments and not change them like you did. A very loyal employee I would say, and from other posts I dont think I am wrong in anything I have said read up on all of the consumer complaints next time before you address the issues you just run accross!

To the other comments thank you for your time responding and even if explaining for not being rude for someone speaking their mind about a consumer complaint against a company.

I can't believe the girl from Savannah called this Theft by Deception !! The borrower would have had to have the intent to defraud and then taken steps through lies, false writings, etc. to make it happen. It is NOT a crime to fall behind on your payments. If the funds were borrowed in the first place under false pretenses it MAY be. If the lender has a valid security interest in the property, then he should just repo his collateral and be done with it. Oh, but wait a minute...if he did that he could no longer charge late fees, or 300 percent interest anymore. And his trained monkeys would have to find another sucker to harass. I feel so sorry for the people that are forced to darken the doors of places like this.
