Sad to say, I too, have been defrauded by Warner, Berkeley, Avlimil or whatever name they go by today. I innocently placed an order for the "FREE" sample advertised on Oxygen network and specifically asked the salesman on the phone if there was any obligation or further purchase required. I was plainly told "no" without hesitation and was not even given any sort of sales pitch. The "friendly" sales rep told me the $4.50 shipping charge was all that was required and I could call back if I decided I wanted to order more of the product. A few weeks later, my Discover card was charged for $70 for an additional 2 month supply that I was told nothing about.
Upon calling back, another "friendly" customer service rep told me to simply write "Return to sender" on the box since it was their mistake and I would be credited a refund, which I did the very next morning. Just in case, I also reported an unauthorized charge to my credit card company, Discover. The dispute department at MY OWN credit card company now tells me they investigated and Warner has provided them with "proof" that the charge is valid, so I will be responsible for the product. OF COURSE, they are claiming they did not receive the product back in the mail. The "proof" they provided is about a 6 page document, including the "training" speech they give their sales staff, which includes an offer to enroll in something called Managed Care. These words were NEVER mentioned to me in the call. Just out of curiosity, I called the toll-free number yesterday posing as a potential new customer to see if they are continuing the same practice. Once again, I asked if there is any obligation to the free trial offer, and was shocked to find out they are still continuing to use the same tactic. There was no mention of Managed Care. It really bothers me to know there are still people continuing to call and get ripped off by this company every day. The BBB web site is showing almost 700 complaints just in the last year for the same thing.
And DO NOT expect your credit card company to help you. I have been a Discover card member for 6 years and was rudely told by several of the reps in the Dispute department that it was my own fault for approving a simple shipping charge. I suppose this means that every time I order something from a company, they can charge my card as many times as they want to without my knowledge or authorization. Discover also told me if I didn't close the account as a lost/stolen card, Warner can continue to charge as many times as they want because it would AUTOMATICALLY reopen my account. Needless to say, I will also be closing my account with Discover for their taking the fraudulent merchant's side in this matter and refusing to accept this as an unauthorized charge.
