Washington Mutual Card Service To Avoid Harrassment, Avoid WaMu! Dallas Texas

I had a card from WaMu for a while; at one point, I requested a "stop payment" on a particular item, unsolicited, from a particular company (that item and company are not pertinent to this report.) They said that it would take several months, and a bunch of paperwork.
In my opinion, a credit card company works for ME, not for every retailer that wants to dip into my account. I informed them that I would pay only the minimum until that one item had been deleted.
I was late making that minimum payment, last month. That's when they became an absolute nightmare.
For the last two and a half weeks, I have been bombarded by telephone calls from WaMu. Starting at 8:30 in the morning, they would call three, four, or even five times a day. (I did manage to get Christmas day off.) The first caller, I told that I would make the minimum payment as soon as possible. That should have been the end of it -- but it was only the beginning.
As the calls kept pouring in, day after day, I finally had enough, and decided to sue these bastards. So for the past few days, I've been informing the caller (it's always a different person) that they would be sued, not paid.
I contacted the Justice of the Peace in Texas, in regards to filing suit. (That's who you need to talk to, and the number I have for them is 214-904-3188.) They told me that the suit must be filed in the "district" in which WaMu is located, there in Texas; I now have a physical address for WaMu in Dallas, which is where the bills get sent to. That address is: 9625 Audelia Rd., Dallas, TX 75238. I'll be calling the Justice of the Peace back with this information, and they'll send me the packet of info needed to file a claim in small claims court. I will be filing a suit for harrassment -- and making a tape of everything on my caller ID machine, to use as evidence.
I also decided to start taping their calls. This morning (Dec. 30) I got the usual 8:30 a.m. call, and informed the caller that I was suing (which I'd told the previous 7 or 8 callers) and that this call was being taped, by me.
Lo and behold, not another call, all day!
I'll give 'em a couple days, just to see if I get to record any more of their harrassment. I suspect that telling 'em they were on tape, is what made them stop! The next few days will tell. HOWEVER -- if they think I'll just let this slide, they're dead wrong. I will be pursuing this suit, for the maximum amount allowed by law (10K in a small claims suit.)
Friends, don't put up with this kind of guff -- go after them, and mean it!
Then, cut up your WaMu card.

As a first piece of advice, you do not deal with problems by only paying the minimum until they fix something. This just gives them more interest and puts them against you from the start.
Also, if you miss a payment, they have the responsibility to call you to ensure you pay. If you would have made a payment by making a transfer over the phone the first time they called, they wouldn't have called again, but until you actually pay, they have no idea. They have a computer in front of them and a list and they have a couple hundred people who just make calls, when you don't make a payment you are moved to the bottom of the list and are called again when someone gets to you. They do not know what you said to the last person, they just know you have not made your payment.
Third, I have checked the Texas Constitution and Statues (Sources of all state civil and criminal laws in Texas) and there is not a charge for them harassing a customer to get a payment. (Check for yourself at http://www.statutes.legis.state.tx.us/)
There is however a clause in their law that states if you sue them frivolously (without having any legal backing) you will have to pay all of their legal fees. Since they were just following legal procedure to collect on a debt that you would not pay, you have no legal backing and this could be considered a frivolous law suit.
In addition there is the fact that you will have to pay for travel costs and legal expenses to sue for little money and possibly ending up having to pay money.
Think of the risks to you before suing.

i am a Call Center Call Governing Program Writer, i am not going to say weather it is for this company or not but i will tell you this, I know for a FACT that they can and do see every thing you spoke about with the previous caller. after college i started working for the company that writes the programs that these companies use to govern their calls. the program that they use allows them to review all calls made by that customer, after each call taken the CCREP is responsable for placing a note into the customers account, the note must contain the reason for the call, what was done to resolve the situation and any adjustments made to the account. this is how the company keeps track and protects itself from such lawsuits....... so like i said everything is documented so if you want to help yourself never raise your voice or use profanity.
Washington mutual is by far one of the worst customer service banks around, they don't care about their customers but the money they can steal from them.
