This is a letter I want to send to the collector. This is a second attempt and I keep records of the first one for which I never received a response.. thanks in advance

To whom it may concern

I am writing in response to your letter received on 01/15/09 dated 01/09/09, (copy enclosed) concerning the collection of the referenced account to my name because I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA).

In addition, I advise you notify your Client Pinnacle Credit Services that I already responded a similar letter on 08-07-06 for which I keep records of the letters and certified mail receipts. On that letter I requested validation and also requested that if fail to respond in 30 days from the date of my dispute receipt they should delete all references of this account to my name. (Copies attached).

This letter is being sent in response to your letter and in response to the refusal of your client, Pinnacle Credit Services, to delete an inaccurate debt associated with my name from their and your records. On August 08, 2006, Pinnacle Credit Services received a demand for validation from me in response to claim similar to yours coming from Merchants Credit Guide (See copies)
As you may or not be aware, as per the Fair Debt Collections Practices Act (FDCPA) Section 809 (b), upon receipt of my demand for validation, you can no longer legally pursue any further debt collection activities until you have responded to my request with the proper documentation of this alleged debt.

I am hoping Pinnacle Credit Services will resolve this issue by deleting the reference account from yours and their files. While I prefer not to litigate, I will have no choice but to begin a more detailed investigation regarding my legal opportunities against Pinnacle Credit Services if you do not delete this account from you files, and discontinue all collection activities within 10 days of receipt of this letter.

I will file complaints with the office of Illinois Attorney General as well as the FTC if Pinnacle does not rectify this situation.
