First, let me say that I am truly sorry for the predicament you find yourself in. Now, let's get to the good stuff! You have a blatently open and shut case here and you may even be able to make a little money off of it; if these agencies continue to drag their heels. Consumers are just SO under informed when it comes to their credit and their options. First and foremost, send a letter of dispute to Experian. Send it certified, return receipt mail so you have proof it was received by their office. In this letter, you should state that this has been an on-going problem and it needs to be settled immediately. Request an updated copy of your credit report also, to verify they have removed this item. They should have sent you one the last time, which would have reflected "no change" in the staus section. They have 30 days to take care of this.
The second letter you need to mail (in the same manner as the first)will goto the creditor listed on your credit report. In doing this, you are covering all of your bases. They should not be reporting it, and the reporting agency shouldn't be listing it! So now, you wait the 30 days for both parties and see what happens. If this matter still hasn't been cleared up in the 30 days, mail a follow up letter to both organizations and let them know that they have 30 days to resolve this to your satisfaction or they will see you in court. Also let them know you will be filing complaints with the Federal Trade Commission and your local State Banking Department. Don't back down!
If, after the total of 60 days, the item is STILL being reported, file in small claims court against both parties. Also file the complaints with the FTC and Banking Department. Sue trhem to the tune of $1,000.00 for each agency for a grand total of $2,000.00 in your pocket and THEN the court will force the item off your credit report.
