While trying to get a home improvement loan through the USDA, it was discovered that there was a lawsuit listed on my Transunion credit report that should not have been there. This lawsuit involved a nursing home bill for my mother who was a resident. While I was trying to get her signed up for Medicaid, the nursing home turned around and sued my mother and I for unpaid rent. In court, the judge ordered the lawyer for the nursing home to dismiss the case against me because he said that I was NOT responsible for my mother's bills - which the attorney did do. When the judgement was rendered, it was found in favor of the nursing home against my mother ONLY. This information is clearly detailed on the court docket. Also, when Medicaid kicked in (about 8 months later), they went back and paid the entire debt that had accrued (actually giving my mother a credit balance for awhile). For some reason, the nursing home's attorney never bothered to file a "Satisfaction" with the court so it appeared that the debt had not been paid. I contacted Transunion and disputed the lawsuit on my credit report on the grounds that 1) the case against me had been dismissed PRIOR to judgement and 2) the debt had been paid several years ago (the original court case was started in 2005). I got back the ruling that the lawsuit was "Verified" and they refused to take it off. I complained again over the phone and, again, they refused to remove the info. I pulled up the court docket and made copies of it, as well as the nursing home statement showing where Medicaid had paid in full and the Satisfaction to the court (which had finally gotten filed after I made a stink to the nursing home about it). I sent all of these copies to Transunion and, AGAIN, they refused to remove the nonsense from my report. Funny thing is, I pulled up my mother's report and the lawsuit is nowhere to be found. I have managed to clear this nonsense with the USDA so I'll still be able to get the loan and I have contacted the FTC and filed a complaint with them but Transunion STILL refuses to take this lawsuit off my credit report - even after it has been proven to them that, not only did I NEVER owe the nursing home anything, but no judgement was ever found against me. Because of their incompetence, it looks like I owe that damn nursing home $20,000+ - $20,000 which was never owed by me and $20,000 which was paid YEARS ago. They say they won't remove the info until 2013 but I say it should come off IMMEDIATELY!

It should be removed immediately. You need to contact an attorney and SUE Transunion for violating the Fair Credit Reporting Act.
There are plenty of attorneys who will be more than willing to take your case-it's a sure win.
Good luck.

Thank you for the acknowledgement and well wishes.
Unfortunately, I am in a very rural part of the country with few attornies and none who seem interested in the case - even though, with it being such a small town, most know about the lawsuit and the situation in general. I think they feel that, because I'm not really out anything (since the USDA is still approving me for the loan), there really isn't much $$ to gain.
That's why I reported it here - I'm hoping that an attorney will see my complaint and contact me, willing to take the case on a contingency basis. Not only would I have an obvious case against Transunion but I'd also have a case against the attorney for the nursing home since he failed to file the "Satisfaction" with the court in a timely manner and probably against the nursing home as well for failing to make SURE the "Satisfaction" was filed.

Just got a letter from Transunion saying that the lawsuit nonsense has been deleted from my Transunion Credit Report. Don't know if they finally decided on their own that they needed to investigate it instead of just blowing me off or if Ripoff Report got involved and MADE them decide. It could be that, after filing 4 disputes with them and contacting Ripoff Report and the FTC, they decided I was a big enough pain in the fanny that they better clean up their act.
Anyway, thank you Ripoff Report for just being here - maybe my story will help the next person.
