Capital One Mastercard Credit Card Ripoff stolen by my son racked up $5000.00 bill and Capital One makes me pay Scarborough Ontario

I was working 500 miles away from home, my 15 yr old son stole my credit card from my wallet, hidden under the seat of my pickup truck, while I was home for a one day visit. I left home for a month to work and during that month my son used my Capital One Mastercard 3 to 5 times a day for 27 days withdrawing cash advances from banking machines.

Many days he would reach the cash withdrawl limit and just wait for the next day to begin withdrawing cash at 7-11 cash machines. The total was $5000.00 before someone phoned me to tell me my son had my Capital one Card and was throwing $20.00 bills away and lighting cigarettes with them.

From 500 miles away I phoned Capital One, reported the card stolen, had my son arrested by the police, he was charged with fraud and ordered to appear before a jugde.
Capital One assured me I was protected by my cardholder agreement as long as he was charged.

Then the surprise, Capital One Fraud Division phoned and said because the person was related to me and was a minor, I was on the hook for the $5000.00.

I asked if it was a minor who was not related to me if it would be the same. No, because he was related and a minor, I am responsibe, even though he in fact stole the card, guessed my pin, as he knew my Bank Card Pin he just tried that pin and it worked (Never use the same pin for multiple cards I learned)

Anyhow, although I had never in 5 years made a cash withdrawl from my Capital One Card, and suddenly now 3 to 5 withdrawls a day were being made over 27 days, Capital One never once tried to call the me; the Card Holder to see if the withdrawls were genuine, one would think there should be some responsibility on Capital One to catch such wild spending, especially since it had never occured on the card in the past.. No way, they say pay or we will wreck your credit, no discussion, no supervisor to talk to, nothing " Frank " the fraud investigator for Capital One simply told me he is the only person I can talk to, and he has decided I must pay.. He said there is no one else to talk to,, The buck stops with Francisco B.

I would think that at the very least Capital one is 50% responsible, as the transactions should have been red flagged at some point, but no, Frank says pay or your 30 year excellent credit history is going to be wrecked..

I guess I have to pay, but anybody with a Capital One Card should think hard about keeping it. The people at Capital One are rude and ignorant, and they seem to love to be confrontational. as well as lie,, I was told at the start of this I would not be liable as long as a police file was started, that was done.. then Frank called to say .. pay up or we fry your credit..

How horrible

That is a horrible thing to happen. It shouldn't matter weather the person is related to you or not. As long as you pressed charges, Capital One should NOT charge you what happened.

Though I could never understand why a parent would press charges against thier child, but that is asides the point.

Capital One should waive the charges

Son Charged with Fraud.

I'm terribly sorry that happened to you my friend. You mentioned that your son was charged and Capital One still did not stand behind there guaranty. My thought is this Don. The police charged the boy right? Did they do it on your behalf with an incident report from you ? Is the charge being pressed by you or the police? my thought is this maybe Frank figured that seeing as how the thief is your son by name etc, and maybe you have the power to drop the charges or just not show up to the trial as the Crowns witness maybe he figured that you have the upper hand and will not go through with the charges after all? Anyways it is just a thought, really sorry to hear that Don. Are you making the boy help you pay it off? or are you considering legal action? Maybe you should contact MasterCard Directly not just capital one. You might find some understanding by the Master Card Company itself with a grievence? Thank you for listening sir.
