Mattress Warehouse close to white collar criminals Lynchburg, Virginia

As a former menswear retailer & lecturer on customer relations I found Mattress Wearhouse to be one of the worst retailers ever encountered. We purchased a Simmons "Fordham" mattress in fall of 2011; within 6 wks it was found to be defective by a 3rd party, "mattress marshall". We received an Email from corporate in Frederick,Md. advising that we could get another of the same make & model & would be charged $65 for the exchange fee. If we wanted another brand/model then we would be allowed $712.50 towards the trade (we paid $950). We opted for the same mattress but stated that we would not pay $65, period. After some back & forth, they agreed. Within 2 wks this mattress was also declared defective, We were again advised as above: $712.50 trade allowance ($237.50 less than we paid). After several Emails and a certified letter advising them that we would not take a 3rd Simmons "Fordham" and we would not accept less than what we paid, $950, towards another brand, along with the notice that we would take them to small claims court if they did not comply with our request, they capitulated. Having owned a Temperpedic for nearly 20 yrs, we went to another store and decided on another of this brand; They cannot play games with the prices on this brand; all other brands cannot be compared from store to store because the same item is given a different name for each store. Thus in their ads & in-store signs they proclaim that they will beat any price on any mattress from any competitor......but when there is no "Simmons Fordham" in any store but theirs, how can you compare ? False advertising.They are also not in compliance with several Virginia state statutes. Consumers should stand up and not be taken by firms such as this. I never threaten suit unless I am 99% sure that I can prevail. I have sued and/or threatened to sue about five firms. I have always prevailed. It is easy to obtain a warrant; the judge will side with you if you have a legitimate complaint. More consumers need to stop being screwed by unscrupulous firms such as Mattress Warehouse.
