I reported and escalated two claims to PayPal.

First was the case of a purchase through ebay from a company called GearXS.com.
   I ordered a router, it came and was defective.  I called the company multiple times and finally got a shipping label and filed for a refund.  They took three weeks to actually get me the shipping label, then 6 weeks after that I got the exact same router back in the mail.  I submitted bad feedback on ebay and they sent me an email and said they were going to send me another shipping label and that it was an error,  Now 2 months later I still haven't seen the shipping label.  GearXS.com could care less, because it's now been too long and PayPal refuses to protect me after doing what they recommend "resolving the problem directly with the seller/buyer."  My escalated claim for a full refund from PayPal: Flat out denied electronically, it wasn't even looked at by a real person.

Second I stumbled upon a site called lock-unlock.com for unlocking a phone.
   They are basically an off-shore setup to steal money in order to tell you information you can find off a "how-to unlock a phone" article or anywhere else.  I saw PayPal for the payment and figured I was backed by the ability to get my money back.  Turns out PayPal won't refund me for this purchase either, I escalated a claim and it was flat out denied as well. (also electronically, no person even had to look at it)  I also sent an email to the website's contact, of course it has been a month, no response, I'm sure my money was already spent on some budget hooker in another country.

After both of these cases and reviewing PayPal policy and their "guarentees" on how they "protect the buyer".  I went ahead and sent an email asking flat out "When do you actually protect me?  Any time I actually need your help, you are not there for me."    It has been a month since I sent that email to PayPal, and I haven't gotten anything from them either.

PayPal protecting the buyer?:   False.

You can forget about PayPal protecting you, because in the end all it's really about for them is that 3% commission they make of people buying and selling through them.

Sad truth

Paypal may not have helped you but, there is really nothing they can do from a legal standpoint. You did receive your item even though it was ... Not as Advertised/Faulty/Wrong Order/ Ect. One of the few ways Paypal can actually refund you is if you did not receive the item at all, its plain and as simple as that.

My friend has made dozens of paypal disputes over several purchases he made on the internet and all of them won. The only reason is because he reported that he did not receive the item. He bought CD-Key for a game to support a friend, they sent him a fake and all he had to say was he did not receive it and the site was a phony, all his money back. He bought from ebay and received an item in horrible condition while it stated brand new, all he had to say was he didn't receive it and the seller couldn't prove it in the dispute that they did send it (That was their fault) and he got a full refund.

I made a purchase on an online website for a virtual item and only to get banned later on. I made a Paypal dispute 45 days later claiming that I had never received and, I got full refund.

To cut it short, just claim that you never received the item, and paypal will pay more attention to your disputes. Even if you do and it was a scam or not as advertised, just claim it was sent to the wrong adress and that you want a refund for an item you didn't receive.

I know that may be a rip-off as well but, it is sometimes the onlyway to acheive justice. Sad but, true.

   So we should just cheat the next one down the line?  I certainly agree that two wrongs make a right as long as I get mine,  right?
   Take a second and listen to yourself before offering advice.  Lying to paypal makes "your friend" no different than the original scammer and does nothing to stop them.

  I would also like to add that I recently got an e-mail from the Better Business Bureau Iowa who I used to file a complaint with GearXS.com.  It has been over a month that I filed that complaint and BBB.org sent me an e-mail saying that they were unable to contact the company to even begin to resolve any issue and that it would be reported as a part of their inability to even respond.

  To comment on John of Rhinelander, USA: no, two wrongs does not make a right, people should not be posting their claims as unreceived.  However, PayPal does not take any other claim seriously at all, what then are we left with?  What bothers me here, is that PayPal's help system is all run electronically, which makes any escalated claim result in instant denial.  Like I said I wasn't even able to receive a response from PayPal when e-mailing the same information.  PayPal is just doing justice to it's long outlived slogan of protecting the buyer, by showing that they are not really there to resolve an honest problem.
