Sears Home Improvement not only rips off consumers by charging 3-4 times the market rate for the same work and materials, they are also in the practice of back charging their salepeople based on third party 'Sears (not so sears)' installers.
I was employeed in the Boston / Manchester office and was told I was a top producer in that office during my tenure. I worked excessive hours, traveled excessive distances, and was not on any type of corrective action.
After I quickly realized (10 months) that it was costing me more to go to work than I was making, I took a better look at my commissions, and well, Sears was backcharing me on the basis of vendors backcharing them.
The irony was, the vendors were (and documentedly so) ripping them off. Sears simply passed the buck to the employees. Managers were well aware of this process.
I took my issue to the Labor Board, and my approx. $23000 in back charges for my 10 months of employment. After two hearings, and selling the hearing officer on the notion I intentionally ripped sears off was dumbfounding. To top if off, the sales manager threatened to counter sue.
Their mis-management of employees, and vendors, very often extended to those poor over-extended credit customers with lack-lustre installations.
Shame on you Sears.

I worked for Sears Home Improvements for about 4 or 5 months before realizing the same thing. The cheated me by refusing to pay me earned commissions. I drove all over the place, using my own vehicle, own cellular home, own gas, not a single expense was paid by Sears. I too was the top sales person my first month out on my own. I began to realize much of what I represented to customers was not true. Sears is great at blaming the sales person, the production department and/or the installing crew. I quickly realized it was just a great big three ring circus. I lost all faith and belief in the product I was selling and even more the company I represented.
I have filed a wage claim with the dept of labor and they found in my favor. Sears is appealing the Dept. of Labor's Administrative Order of Determination ordering them to pay me just over $12,000. Sad when all I asked for was 1/4 of that and they refused. Now the state is requiring well over my claim. I wonder if Sears will find a way to refuse me owed commissions. I wonder why Sears would spend the time and money to hire attorneys licensed in the State of Oklahoma to represent their appeal. An appeal against the Department of Labor. Wouldn't the Dept. of Labor know the law? Is Sears so greedy that they would hope to prolong the claim and hope I'll go away? Maybe so.

Sears Home Improvement should not be able to hire indenture-servitude type labor practices in any state. Management of the company is seemingly above local and state laws governing the recruitment and employment of individuals requiring time and efforts WELL below the federal minimum wage law.
I encourage all to view state superior court records for hearing and appeal documents that are public to get a 'tone' of the treatment of its employees by management, which mirrors mordern day free labor a.k.a. slavery
I would also encourage all past employees to network together so all changes are not dismissed as a 'one-off' scenerio.
Sears Home Improvement Sales Management are lying on behalf of senior managment to protect their roles within a very transient environment. They will stop at nothing,,, and in my case purgery,,, to protect themselves from actually having to manage their respective units.

you lost? If so, wow! Did the State find in your favor before the hearings? Just curious because my hearing is scheduled late January, but the preliminary hearing is actually between the State and Sears because the State issued an Adm. Order of Determination requiring Sears to pay me. Sears is appealing the State's Order. Anyway, thanks for the advice and I'm sorry for your situation.
I'll do some research and hope for a better outcome.
