I worked for Wal-Mart for 6 and 1/2 years. I was loading a truck on June 26, 2010 (Saturday). It was my last truck of the day. We had a heavy rain fall begin and I was really looking forward to going home. The rain started to come in where the truck and the building meet and it was making it diffucult to drive in and out of the truck across the dock plate.
I had about half the truck loaded and my single jack got stuck in the dock plate due to the rain. There was about an inch or two on the floor of the truck. I got off of my jack to trying to get it unstuck. I slipped in the rain fell on my butt and immediately felt pain in my butt, back, leg, and elbow.
By the time I got off the floor, another loader drove to my door to drop off more trips for me to load into the truck. I was crying and told him that I fell and had to go to the front. I couldn't even lift my right leg. I had pain shooting down it and it felt numb.
After contacting my Supervisor about my fall, I asked to go to the ER. In the ER, they x-rayed my coxyx and determined that it was broke straight through. I was sent home and told to see the company DR on Monday.
The company DR told me that my coxyx was not broke and I would be able to return to work that next Saturday. I was given pain meds and sent home. By Friday, I contacted the DR, needing another vist, and told him that I was still in tremendous pain. I couldn't sit, drive, or lift my right leg at all. He gave me another week to recover, more meds and told me that if I still didn't feel better by the next week that he would order a MRI.
The next week I went for the MRI and had a follow-up appointment a few days later. The DR told me that the MRI showed nothing wrong other than the normal wear and tear of anyone else my age (33) and that I was good to go to work that next day with NO RESTRICTIONS. I was in shock! No restrictions? He also told me that since I didn't have a work related injury that Workman's Comp would more that likely demand I pay them back the care they had provided thus far.
I went to work Saturday, worked for maybe an hour and a half and could not do the job! I asked to go back to the ER and was told NO. I could just return home if I couldn't do the job. I had no choice but to go home. I called in Sunday and Monday.
Monday, I made an appt. with my regular DR. After telling her what happened and asking her to read the MRI results, she was not surprised by what was going on. She told me that is the way they do work related injuries. I indeed had 4 bulging discs and some nerve damage. No wonder why I felt so bad. So, I hired a laywer.
Here we are March 2011, I have not received any benefits for my injury. I feel the same way as I did about 3 weeks after I fell. My lawyer wants me to settle for $4000.00 and I think that is a ridiculous insult! I only received Workman's Comp benefits until the company DR told me that it was not a work related injury. NOTHING since that time Aug, 2010.
There has to be more to it than this. I have lost my job, had to sell many personal items, struggle with relationships with my husband and children. I'm not asking for a million dollars. All I want is to feel better! Simply jumping on the trampoline with my kids, playing basketball with my daughter, driving for longer periods of time without being miserable.
Wal-Mart or any other employer should not be able to treat people this way! It's absurd!!

Go find another lawyer to sue Wal-Mart for all your injury troble (doctor bill, ER bill, lost pay, etc). Make sure new lawyer do not use Wal-Mart doctor for prove. Get with your own private doctor and have your doctor (not Wal-Mart doctor) and your lawyer work together. Wal-Mart doctor and Wal-Mart set-up fault information system on you.
Get another laywer.

What ever you do,make a call to OSHA,there should have been no rain coming in the trailer to begin with,making your job dangerous.

I just want to say I hope you're feeling a little better from your injury. I know how nerve pain feels, I used to work at walmart from 2007 and injured Aug. 2009 after a back injury I got while unloading a truck. When I first asked to go to the ER I was told 'it was my decision. But, if I left i may lose my position.' I can't believe a company so big can treat they're employees like this and get away with it. I was not offered any kind of compensation. In fact, I was denied workmans comp, and unemployment benefits after being terminated.
I had 3 employees as witnesses 2 were terminated prior to testifying on my behalf. So they were 'Not reliabe witnesses.' I also have a customer that witnessed part of what happeed. My lawyer decided she didn't need to testify. I also had numerous people family and friends that I was texting throughout that day asking what I should do (stay or leave.) And letting them know what the managers were saying to me. However, again my lawyer didn't feel having that many people testify was necessary.
I did post my own Ripoff Report about my issue because I feel that walmart needs to be held accountable for the way employees are treated and how serious injuries are often ignored!! but of course I guess money does keep people out of trouble with the law and allows them to treat whoever however they want with no worries. Something Needs To Be Done!!

Lawyers can't or won't fight such a major corporation. I was employed at one of their DC's for almost 4 years. I was a completely healthy, active 37 yr. old single mother and within 4-5 months or less of lifting thousands of pounds an hour for hours and hours, I began to realize something was wrong in my upper back. The immediate care place they take you to in our location, of course, tells you and them that you are fine or to have some light duty work which they don't comply with and make very light and to go back to work. I was also told I was getting old. Seriously?? At 37? I got a lawyer, a small settlement and a change in duty. FF to less than 2 years later and an unknown spill in a room I wasn't in and had returned to grabbed the machine I drove and slammed me into shelving while I was twisted from the ribs up and partially looking up. I didn't have any way to know the spill was there and if I had, no way to clean it up in a room that is kept at 25 degrees. Again with the "you're ok, take a day of rest and come back" crap. This time they did everything they could to get around the restrictions I was supposed to have and eventually my light duty work time ran out and I was forced onto worker's comp. I don't know how a doc that is payed for by workers comp gets paid but this guy ruined me. I was told I would have to do what he said to show effort that I wanted to get well so I allowed a single fusion to C5-6 with an illiac bone crest (bone taken from hip) which was fused with a titanium plate and 4 screws. The original pain from the first injury never did heal itself nor has a cause been found and now I live with the pain the fusion actually caused instead of made better and they wouldn't budge a penny over 38k after a year and a half and the doctor telling us I was as good as I would get as well as given permanent lifting restrictions under 35 pounds. 8k went to the lawyer off the top. Do you realize the life apportionment of 30k is SEVENTY FOUR CENTS DAY to live on for the rest of your life?????
Walmart doesn't give a sh*t because people will never wise up and stop shopping there unaware of what their shipping centers put healthy, active people thru to get their crap to the stores. I'm sure Target or any of the other big box stores are no better BTW.

The same type of deal happened to my wife at Walmart. They make me sick. They create their own laws and policies and our USA government turns it head because they don't have the balls to stand up for us US citizens. IS THIS 1960 RUSSIA? It's starting to look that way. The only way to stop Walmart from getting away with this horses_it is to get the Union (Teamsters) involved. Picket every weekend, talk to all employees, and make them aware of the protection, wages, benefits, and rules both state and federal Walmart would have to follow.
Also a class action law suit needs to be filed by all of the thousands of workers that have been wronged by this scum ball self insured company. Where are all the lawyers when you need them?
Walmart is a trillion dollar company that doesn't care about nothing but profits.... GREED .....
Boycott these SOB's I know I am. What happened to this country? Profits should never come before health.
