I am writing this email to report violations of ethical standards
and/or the law, including but not limited to fraud, waste, or abuse of
authority by the Department of Defense, Air Force, Dobbins ARB and the
United States of America.
In 2005
Dobbins ARB/AFB/Joint Use Base expanded Runway 11 in Marietta Georgia.
This
expansion put my property and others in Fair Oaks into a Clear Zone and
a flight path at 44 feet above ground level.
No
AICUZ's or EIS Reports were done according to the EPA and Cobb County
officials since 1998.
I do not know what
decibel level my property is now in as there are no Noise Contour
studies since 1998 as required by Air Force Mandatory Regulations
whenever the decibel level increases 2 db.
There
does not appear to be any ROD for the Public to review either for the
Extension of Runway 11.
No Public
Meetings were ever held by the Air Force to determine land use
incompatibilities as required by Federal Law 32 CFR 989 including part
989.3 responsibilities and part 989.24 and 989 Appendix C Public
hearings for review and comment on the data.
The
Extension of Runway 11 put my home into a flight path where 84,000
airplanes a year take off and land from Dobbins ARB/AFB/Joint Use Base
and the flight path is 44 feet ABOVE GROUND LEVEL.
This
flight path is detrimental to the health and safety of myself and the
Citizens of Fair Oaks and We the People are requesting to be bought out
and relocated according to the Uniform Relocation Act.
I
specifically believe the actions of Dobbins ARB/AFB/Joint Use Base to
be fraudulent as I understand the specific legal definition varies by
legal jurisdiction. Fraud is a crime and also a civil law violation.
Defrauding
people or entities of money or valuables is a common purpose of fraud.
The
specific wording on page 15 of the Environmental Assessment for Runway
11 Approach Zone Avigation Easements Acquisition for Dobbins Air Reserve
Base, Georgia, printed in September 2004 states:
6.4.3.
Executive Order 12898 "The proposed action would not have adverse human
health, economic or social effects on minority, low-income, or other
communities in the vicinity of Dobbins ARB."
There
is even an elementary school impacted by the noise. Of course the
students there are mostly minority and from low-income families.
DISCRIMINATION.
See the Finding of No
Significant Impact at 9.3 where it states: "There will be no impact to
the socioeconomic health of the community. The proposed action is to
acquire easement rights in the community of Fair Oaks, which has a
predominantly minority, low-income population. Additionally it states:
"The proposed action will have both a positive and negative impact on
land use. The topping and removal of trees will provide a safer flying
environment, but may lower property values as a result of loss of
aesthetic value." Our properties are now defined by the 1998 AICUZ
(newest one we can find) as INCOMPATIBLE.
The
above statement quoted exactly is fraudulent and is harming minorities,
minority children and the low-income community of Fair Oaks in Marietta
Georgia. Our property values have plummeted to zero and the houses are
in a state of boarded up, abandoned and various other stages of
decomposition which was not the case before this 2005 "Avigation"
(another lie as this is our Property Rights and access to the very earth
beneath our feet) was done to us.
It is my sincere belief
that our properties are now located in an 85 decibel noise level which
is clearly unlivable. Permanent damage to hearing of the Citizens and
the Children of Fair Oaks Elementary School is a high probability.
Our
safety is compromised by being put into a CLEAR ZONE and a FLIGHT PATH
with fighter jets and airplanes headed for our very homes at all hours
of the day and night. Safer for who? NOT US the Citizens.
This
Easement is in fact, taking away our Property Rights which is
fraudulent under the guise of an "Avigation" Easement. This is fraud.
Our
properties are now, 5 years later worth NOTHING because no one wants to
live there because of the noise. The DoD, Dobbins and the United States
of America has committed FRAUD against the citizens of Fair Oaks.
This
flight path easement is in violation of Title 42 Chapter 65 Noise
Control Act 1972 which states that "it is the policy of the United
States to promote an environment for all Americans free from noise that
jeopardizes their health or welfare". 42 U.S.C. 4901 (b).
As
it appears that the Department of Defense is doing this to We the
People, I have my doubts about reporting to you about this Fraud,
Deception and Theft as I doubt you will do anything to resolve this
situation.
