The last part of April through May 18, 2009, I was speaking with Michael White and an associate by the name of Lovely, (who has since left the company and can no longer be reached) about renting my timeshare at Massanutten Resort. Mr. White contact me.

Even though I have given my money to a previous so called timeshare selling business, with no results and $600 of lost money, I felt those two were sincere, professional and not a scam.

I was told that my timeshare, a 4/4 lockout, is in great demand and that there would not be a problem with renting it. They also mentioned that they would get my money back for me from the previous timeshare scam artists, and because my timeshare is so popular, I would receive the rental fee of $3600 ($1800 for two weeks of rental) within a month and a half, to include the return of $599 initial payment within a month. It would be used to request my deed.

On 5/18/09, I signed their contract which states that they have 120 days to rent my timeshare and that the charge of $599 is non-refundable. I inquired about this and again, I was told that the contract was standard and that I WOULD receive my $599 back within a month. I was given that information by "Lovely" and Mike White. Unfortunately, I believed them and signed the contract.

However, fortunately for me, according to them, all conversations are recorded. When I called again shortly after that, I found that "Lovely" no longer worked for them. I requested to speak with Mike White, to no avail as of this date, 7/15/09.

The woman who did return my call reminded me that the contract states that they have 120 days for the completion of the process and that they have, on their side, the recorded conversations. Well, if that's the case, I TOO have the benefit of the recorded conversations. It is BECAUSE of those conversations that I decided to trust them and sign the contract. Of course, that didn't make her feel very good at all. The tables turned on her and now I'm using it to my advantage as they thought they'd be able to do with this scam of their's.

I called early part of June that the deed had come back and a contract was sent to a potential renter on 9 Jun. I was told they had 30 days to agree to the terms and sign the contract. I was then told to call back..NOT on 10 Jul 09, but in August! My concern is that if they agree by 10 Jul, why can't I call back AT THAT TIME to get the results of the transaction and find out if I am receiving my rental money and when to expect it along with my initial "deed" payment??!!!

Needless to say, the young lady was very upset with me and again threw up the recording of conversations. As I in-turn, did the same with her.

I called again today, July 15, 2009 because I never heard back from Mike White. I had to leave a message on the recorder to have Mr. Michael White return my call today. That has not happened, just like it hasn't in the past.

I looked again at the BBB to see if any complaints were placed against them. When I looked at that just prior to signing the contract, the words were good. I see now that those words were more-than-likely written by those working at Creative Vacations, not actual clients.

I'm hoping this complaint helps someone else. I will contact my bank and inform them of this situation to get my money back. I am also contacting the Dept. of Agriculture and Consumer Services due to the information I discovered on the website:(((ROR REDACTED)))

I am also going to place a complaint with the Better Business Bureau, who Creative Vacations says they are a member of, and they are not!

I think it's time for everyone to know about the scam artists out here claiming to be reputable third party timeshare seller assisters. God knows what would have happened if I had mustered up almost $1300 to have them sell it rather than the $599 to rent it!!!

Refund Help - No Upfront Fee

Hello everyone. My name is Stephen Jenkins. I am new to this thread and I wanted to give some advice and lend a helping hand to anyone who needs it. NEVER PAY AN UPFRONT FEE TO ANYONE!!! The companies who promise to get your money back are worse than the timeshare resale companies. They are all scams and you will lose everything, guaranteed! Any positive threads or posts which you find online about any of these "upfront fee" companies are typically written by employees. My point being, after doing extensive research on the inner mechanics of the timeshare resale scam I decided to open a small company to try and help people get their money back from timeshare resale companies. We do NOT charge an upfront fee. We do business the old fashioned way. If you get a refund, then you pay us for the work we did. Obtaining a refund from a resale company is a very difficult task due to the dispute prevention system which they all utilize. Dispute prevention is what has allowed these companies to operate for the last 15 years relatively untouched. The dispute prevention tools which they use are time, a contract, and in some cases a tape recording. After much trial and error I have figured out a way to break their dispute prevention system and obtain refunds for most types of victims. I am not going to lie about anything here so read closely. I have only been open for 4 weeks now and I have obtained 4 refunds out of 6 attempts. All 4 refunds were between $1500 to $2000 and they took from 1 to 3 weeks to complete. After a refund was issued to the victim they were then required to pay me a percentage of the refund which is negotiated before the dispute begins. If we do not get our client a refund we do not collect any money at all. We are a three man operation. One of us is in Tennessee, one in Florida, and one in NY. We are three businessmen who have known each other for years and all of us were recently laid off due to company cutbacks in the legal profession. We are currently looking for timeshare resale victims who want to try and get their money back. We will help you for free and we will negotiate a final compensation amount when we speak on the phone. To open a claim with us we would have a brief discussion to see if your specific situation qualifies for a refund attempt. If it does we send you a services agreement. The services agreement is how we protect ourselves. To ensure that we get paid after completion of the refund we require you to sign an agreement promising you will pay us if a refund is issued. This is the only way we have any legal recourse if you decide to take your money and run. If you know anyone who has been ripped off by a resale company or if you yourself has lost money to a resale company please do not hesitate to ask me.
