Furthermore, talent agencies cannot refer clients for photography services if any financial gain is involved or fees are collected for registration. Additional information may be obtained by contacting the Department of Industrial Relations, Division of Labor Standards Enforcement at P.O. Box 420603, San Francisco, CA 94142 or call, 415-703-4846.

In the event that a fee is collected for obtaining employment, and the artist is not employed, the agency must repay the fee collected within 48 hours. They are also required under California Labor Codes to list their license number on all forms of advertising.

$3,000 photo mill racket in Los Angeles
I hear that that [...] and [...] are up to their old tricks again.

A friend of mine had a friend that was "scouted" (so she thought!) by a woman who said she worked in "casting." She was very excited! She was at the Beverly Center.

She called the telephone number on the card and made an appointment.

She went to their offices and met a man named "Stan."

Stan stated that she was right for the agency, but she needed pictures. SURPRISE! Stan told her that she could go anywhere she wanted for pictures BUT... they have a "photography service" right in their office that is staffed by "celebrity photographers" who shoot "top working models."

Stan introduced her to [...] at [...]. Stan stated that his boss, the owner of [...], and [...] were "kind of partners."

Hmmm...

They are in the same suite; they have separate rooms.

Apparently, [...] told her that she launched the career of Carmen Electra, and mentioned a few others that she could not remember. She then said the pictures would cost about $2,650. This charge would not include the zed cards; they would be another $750.

Well, to make a long story short, my friend's friend told [...] that she would think about it and get back to her.

[...] then told her that she needs to get right back to her, because her photographers are "in great demand," and that her "partner" [...] has about 100 job breakdowns coming out daily.

Since then, she has been called by [...] about seven times, asking her to come in for her portfolio so she can start working.

On one of the calls, they said that she had missed out on two jobs, because they had no pictures in her "file."

This company has again changed it's name! They are still ripping people off under the new name of ... Visionary Entertainment and Visionary Productions! It's the same company...SAME SCAM!!! They love you or your child...as long as you fork out thousands for their "celebrity" portfolios! They are NOT a real agency! They work with an agency called Spectrum L.A. They "lure" people in by telling you that Spectrum L.A. will represent you after you "buy" the portfolio. The woman who owns the agency claims that she is not affiliated with the owner's...she just rents office space from them! Yeah...right! She also said that she's considering moving out because of all the "legal issues" with Visionare...now Visionary Productions! Well, we'll see if she does move out! I think she's part of the scam! She has an office in Vegas! I am in the process of contacting the media in Vegas about Murphy.

The company generally responded to refund requests by denying refunds, and referring clients to specific contract terms relating to their refund policies. Their contract specifically states they do not provide refunds. The company disputed allegations of misleading clients on employment related issues. Once again, they directed complainants to review contract terms which clearly state they can make no representation which implies employment probability, or offer any guarantee of employment. Some complaints were closed as unresolved, meaning the customer was not satisfied with the company's response. One complaint remains unanswered.

In February of 2000, the Los Angeles District Attorney's office filed a Criminal complaint in Los Angeles District Superior Court charging the company, and it's principals, Douglas Michael Sholto, and Francesca Detolomei with fraud and misrepresentation in association with their business practices. The company's principals remain out on bail. Glamour closed its doors shortly after.

On March 27, 2001, the Los Angeles District Attorney filed a 9 count amended Felony Complaint (case # BA198638) against the above named defendants. The Complaint charged the couple with Conspiracy to Defraud, and Grand Theft, in connection with the business practices used by Glamour Models. The complaint alleged the company mislead clients into believing that by purchasing a photo portfolio, they would obtain employment in the modeling industry, and, without a Talent Agency License, they could procure employment for their clients. The couple plead " No Contest " to all counts. Sentencing is set for September 24, 2001.

We routinely suggest you read and understand all contract provisions, including cancellation and refund policies before making a buying decision. As of January 1, 2000 new California laws relating to " advance fee talent services " allow 10 days to cancel contracts without penalty or obligation. Re-payments must be provided within 48 hours, or the company is required to pay the artist an additional summ equal to the original amount of the fee. Cancellation procedures should be outlined in your contract or agreement.

But how can one tell the legitimate agents from those who are only interested in exchanging one's bank account for a stack of photos and an education from a local charm school teacher--whose experience is likely slight on the acting and modeling side and much heavier in teaching what they themselves failed to be able to do for a living?"1

"Anyone who claims to be a modeling agency but also sells photos or classes has an ulterior motive to get you to sign with them."2

"Modeling agents said it is preferable for them to train raw talent themselves. Some said no training is generally better than the wrong training, because they don't have to retrain poor habits into desirable ones."

This visionaire company is a complete scam! They sell ugly people marked up portfolios. How can they sleep at night? I hate when scammers from other countries come to the U.S. to scam our people. These people need to go back to their country. Get out of the U.S. I hear they turn young girls into working whore's!!! I heard this from a photographer who used to work with them. He said he quit after he found out the Italian woman who owned it was pimping girls and making quite a bit of money too! Their old name he said was Glamour Models Agency but they were busted bu the police and had to close. It's really sad that people like this actually exist.

I'm so glad to see that this scam company in beverly hills is back on ezbc.com. they have ripped off so many people. the people who own this company know nothing about the modeling business. they just tell people how great they are so they'll buy their stupid portfolios. i had a good friend that went in there thinking they were a "real" agency. they used the name spectrum l.a.. this scam is in the same office as visionaire. spectrum is owned by cheryl murphy who also is co-owner of visionaire. ask yourself why this company has changed their name so many times? go back to jail francesca! What is a photo mill?
A modeling scam in which an individual, group, photographer, agent, agency, modeling school, model manager, etc., financially exploits aspiring models or working models by engaging in continuous sales of photography and/or comp cards and/or portfolios which are overpriced, unnecessary, or by which a profit is derived at the expense of the models under the pretext getting the photography, comp cards, or portfolio will land them modeling jobs worth more than the photography-related expenses.

Red flags:

payment is made to the agency, not the photographer
high sales pressure
extreme pricing
agency recommends only one photographer
similar to Visionare, Visionary, Visionaire, etc.

Visionaire Media has changed its name to Focus! It's the same scam as before. Watch out for this company! They used to be called Glamour Models. They were prosecuted and jailed.

Now there called Focus! www.foliofoto.com Their website is very misleading too! This company is full of b.s. Don't pay them a dime for their "fancy portfolios".

Licensing and Bonding Information

California law requires any company that procures or offers to procure employment or auditions, or that provides artist management services, direction or counseling to develop an artist's career, for any of which they collect a fee in advance, to post a $10,000 bond. Companies that charge in advance for such services as registering or listing the artist for employment, providing photographs, videotapes, other promotional materials, costumes, lessons or training, or auditions are also considered advance fee talent services and subject to this bonding requirement.

BBB Comments and Analysis
These companies advertise for talent with ads that imply that by responding you will have started on your road to stardom. If you answer an ad, they will often tell you outright that they will help you obtain acting or modeling employment. The catch is that everyone who responds needs lessons or training to go before a camera or down a runway, they say. This training is really what these companies are selling, and their courses can obligate you for thousands of dollars. In reality, they cannot guarantee you employment, and you will not find such a guarantee in their written contract.

California law contains certain requirements of advance-fee talent services and prohibitions against certain practices. If the company promises you auditions or employment, or if they even ask you for a fee in advance, a talent service is considered to come under the provisions of this law. Under the law, they are not allowed to charge you, for example, to provide photographs, filmstrips, audition tapes or videotapes, lessons or training.

By law, you are entitled to a refund of anything you pay to an advance-fee talent agency if you do not receive the services you were led to believe would be performed. The refund is to be made with 48 hours of your request for it.

Additionally, you have the right to cancel your contract with the agency for any reason within 10 business days of the date of the contract. If you cancel, your payment is to be returned within 10 business days.

If your written contract does not inform you of your right to a refund or to cancel, you may demand your refund or cancel your contract at any time, without regard to these time limits. If your money is not returned within the 48 hours or 10 days, respectively, the company is required to refund double your money.

Despite the law's protections, if you are not dealing with a reputable talent service, you may find it difficult to enforce your rights.

On July 21, 2004, we verified that this company is not licensed with the Industrial Relations Board as a talent agency.

It appears this company is currently being operated by past principals of Glamour Models, Michael Douglas Sholto and Francesca De'Tolomei. Although it remains unclear if either of the above mentioned individuals have any ownership interests in the company, current complaint activity would suggest they act as management for both Visionaire and Visionaire Photography. Similar complaints have been received on both companies. A separate report for Glamour Models is available upon request.

Complaint Experience

Some customers state after paying fees for photography services, or representation they received the run around, listings, or no payment was received. Others allege the company overcharged for photo packages, services were not provided after the company represented they could market the customer to agents, or the customer was not aware the $100 deposit was not refundable upon cancelling a photo shoot since the contract was not cancelled within three days. One customer claims Spectrum collected a fee for representation and then indicated a photo shoot was required. This customer reports after paying the $125 non refundable deposit to book a shoot, the photographer offered vague answers for the cost of zed cards, head shots, and portfolio pictures and proceeded to read a list of casting calls and jobs. This customer also claims the company employee would meet in a private room every time a question related to money.The company responds to complaints by issuing credits, stating they fixed the problem, offering explanations, or indicating they could not locate the customer's record in their files. The company contends they are licensed and bonded. In other cases, the company responds by stating the customer received a contract and could get the pictures anywhere, explained that they needed the negatives to proceed, or indicated the client never signed an agreement or paid for services.
