Heartland Payment Systems Nafi Bendetson termination fee billed in error refuses refund Princeton New Jersey

Our business signed a merchant services agreement with Heartland Payment Systems approx a year ago. The agreement was set up month to month. No cancellation fee. I have this in writing. We decide to change vendors due to poor service. After sending in a requested cancellation letter my bank acct is billed $295.
The rep on the phone said nothing about this fee when I requested to cancel. I call back to dispute the fee and request a refund. The next rep plays games and claims they can not pull up my business at all. They claim they have no record of it!
I had just spoken to them a week before and they had no problem finding my acct when they thought I was a customer.
I am given the name of Nafi Bendetson as the area mgr in LA. He refuses to return several calls. The rep that set it up I find out is no longer with the Co.
I ask around and find out this company has high turnover and hire commision only sales people. they come and go every month.
I would not do business with Heartland!!!!

Heartland Payment System's standard contractual term is 3 years. That is present in several places including but not limited to the Terms and Conditions of the contract that you were presented with, on the actual contract that you signed, and on the standard “Notice of Cancellation” form that our company utilizes. Our standard practice dictates that we fully review any dispute our former clients may have if they fail to fulfill the contractual obligation that they entered into with our company. We do this on a case-by-case basis and make the appropriate refunds if merited. If you have a written agreement as stated that indicates a month to month term and no Early Termination fee please forward this at your earliest convenience so we can resolve this issue.
“Poor service” is something that is not part of the Heartland Payment Systems culture. We have a dedicated sales force in all 50 states. We also have a local dedicated service team in all 50 states. We offer customer support 365 days a year, 24 hours a day at our Service Center.
Because we do take all merchant complaints quite seriously, if you have a particular instance in which you felt that you did not receive world class customer service feel free to report it to Team California Customer Service Line at (866) 976-7203. Your case will be given the due diligence that it deserves as we do for each and every one of our clients.
