I continue to receive harassing phone calls from a Joann and the "infamous" Matt!!! I tried to explain due the rain here in phoenix, work has been slow. Which i was told "who cares?" They call all my references telling them that i have fallen behind in my payments and my truck is out for repo!!! I have several recorded messages and conversations showing the unprofessionalism that is practiced regularly. What i want is for everyone here going forward to make copies of your messages that are left on answerings machines...
P.S. can anyone get me the fax number....then pass it around so we can send a massive wave of "CEASE AND DESIST" letters. This way they can only correspond via mail. No one at "sorry finance company" will give me the fax number.

THIS IS 1ST PARTY COLLECTIONS SO THEY CAN DO AS THEY PLEASE & WE LIVE IN A STATE THAT HAS NO CONSUMER OR LABOR LAWS. THATS THE WAY THE STATE GOVERNMENT LIKES IT. JUST LOOK AT ALL THE STUFF SHERIFF JOE PULLS. THIS COMPANY DOESNT EVEN HAVE TO HONOR YOUR CEASE & DESIST DEMAND & THEY CAN CALL YOUR RELATIVES ALL THEY WANT. WHAT YOU SHOULD DO IS EITHER GET USED TO IT OR PAY OFF THE ACCT

I'm going to let you in on a little secret. Working for a large bank that does collections etc etc. There are those things which are legal and those things which are not. It is illegal from a company to harrass you and if you ask that they submit everything in writing they do have to do that. A company is not allowed to reveal things like "we're going to repo the vehicle" or "so and so isn't making their payments as scheduled" to a third party excluding your attorney, that is against federal collection laws. Also they are not allowed to threaten or intimidate. They are not allowed to call before and after certain times. They are also not allowed to swear at you or use language that is anything other than professional. Also they have to disclose who they are and who they represent. I'd suggest you look it up. Also when you sign a contract with any company if they fail to honor it said contract becomes null and void. Just like if you don't honor the contract. If your loan paperwork says you have an X day grace period then you have that grace period before any fees can begin to accrue.

FDCPA DOES NOT APPLY TO 1ST PARTY COLLECTIONS & AZ HAS NO STATE LAWS THAT PROTECT THE CONSUMER. A CASE COULD BE MADE FOR HARRASSMENT, BUT THE LAWS ARE VAGUE AT BEST. ONLY A JUDGE CAN DEFINE IT. THERE USUALLY HAS TO BE REPEATED CALLS WITH AN INTENT TO ANNOY.
ALSO, I REMEMBER VERY WELL THAT A DEBTORS PERCEPTION OF HARRASSMENT CAN BE A LITTLE OFF. WHEN I WAS A COLLECTOR, I WAS ACCUSSED MANY TIMES ON THE 1ST CONTACT OF HARRASSMENT JUST BECAUSE I PROBED AS TO WHY THE DEBTOR WAS NOT PAYING. IT S A WAY TO GET ATTENTION AWAY FROM FROM THEM & WHY THEY DONT WANT TO PAY. I SAY WANT BECAUSE IN MY 12YRS OF COLLECTIONS, I NEVER HAD THAT PROBLEM WITH SOMEONE THAT COULDNT PAY. THEY ARE MORE THAN HAPPY TO TELL YOU ABOUT THEIR SITUATION.
NOW, I NOTICED THAT THIS POSTER, FOR INSTANCE, CLAIMS THAT NO ONE AT THIS COMPANY WOULD PROVIDE A FAX NUMBER. A QUICK 10 SECOND GOOGLE SEARCH NETTED ME THE COMPANY WEBSITE. ON THE SITE IS ALL THEIR CONTACT INFO INCLUDING A FAX 1(801)844-2600.

Bill I noticed that you didn't touch on the legallity of which there is none of this company calling references giving them info in regard to the loan. They are NOT allowed to do that and you and I both know it. All they can really do is ask that the reference have the custoemr call.

THERE IS NO FEDERAL LAW IN REGARDS TO 3RD PARTY DISCLOSURE. SOME STATES HAVE ADOPTED THE FDCPA AS THEIR STATE LAW & APPLY IT TO 1ST PARTY COLLECTIONS BUT AZ IS NOT ONE OF THOSE STATES.
