I went to Bob's Discount Store in Yonkers, NY and went into "The Pit" to purchase a sofabed as I moved into a new apartment.  The "Pit" is like the clearance section of the store.  Basically, the merchandise was previously in the showroom and they want to get rid of it to bring in new merchancide.  The only down side to this is nothing is returnable.  Everything is sold "As Is"

I found what I thought was a beautiful chocolate chenile sofabed at a great price.  Well.......a few weeks later, I had relatives spend the night and I was excited to sleep on my "new" sofa bed.......  When I pulled the bed out, I was horrified beyond comprehension!!!  My "new sofabed" had blood stains all over it...  I was so sick over it!  To add insult to injury, I had no where to sleep.

I was absolutely disgusted and irate!!!!  I cannot fathom the thought that any "legitimate" business would have the indecency to even THINK about giving a piece of garbage like that away for free, let alone sell it for money!!!!   The sofa was originally priced at $600.00 and I got it for $299.00.  What a great BARGAIN I thought I got.  I certainly got more than I bargained for. Bob's, shame on you, your management and your sales people.  What you did was vial and against the law!  Why don't you take a blood stained bed home to your wife and see how she likes it!

I called to speak to the manager to no avail.  The manager was "always" busy with another customer...  Blah, blah, blah........  To date, I have never received a call back and put the sofa in the garage.  I since purchased a Brand new sofa from their competitor.  I will never ever shop at Bob's again.

Just a thought.

Since the sofabed was on the showroom floor, didn't you think of opening the sofabed while in the store to make sure it works and had all of its parts?  If you did you would have found the problems with the sofabed.  When you buy something "As is" you need to check the item out before buying/taking it home.  You didn't even check the sofabed when you receive it.   How do you know where the stains come from? Do you have other people in your apartment?

Depending on your exact state laws they may or may not have violated laws on selling used mattresses.  Your mattress would defiantly be damaged but most likely there is no laws about selling "damaged" mattresses.  So you would have to find out if what they sold you would first qualify as "used" and second if they did violate any laws.   If they did violate any laws then that would override any "As-Is" clause and you should be able to sue them in Small Claims. 

On the "flip side" this is a Sofa Bed right?  So since presumably you are buying it for the "bed" feature.  If so why didn't you at least pull the bed portion out BEFORE you bought it?  Especially with an "As-Is" item.  What if it didn't work, what if it wasn't comfortable?
