Mesquidar Man Gary Goins Did not deliver product, not delivering refund Fredericksburg, Texas

My husband ordered and paid for 4 - 12ft stripped cedar posts from Mr. Goins in December 2010. We did not hear from him and did not receive any product for months. Finally made contact in April 2011 and asked for a refund. As of 9/19/11 - we have received $200 of $500 and it has taken repeated phone calls and each time we are told that he doesn't have the money.

Mr. Goins, The Mesquidar Man, has had an interest free loan from us (essentially) for almost a year. Since we are in a small town, we wanted to be civil and try and work it out. We also figured that it would be more effective to try and work with him than go to small claims court.

We are filing with small claims court today. Mr. Goins does lovely furniture work, but I wouldn't pay for anything in advance or expect delivery on time.
