James is currently on Probation for Aggravated Domestic Assault and he has a Personal Protection Order against him. Latest information has revealed that he has two bench warrants for his arrest and he’s a Dead Beat Dad.
I was originally contacted by James in February 2010 and he was representing Jaguar Media.
He told me he was the Producer and was interested in featuring one of my rifles in his productions. Broken dialogue continued over the course of a year and nine months. During this time, I had a lengthy telephone conversation with James, where he informed me of his supposed status in the Media Industry. James touted being able to provide coverage in numerous shooting related productions. Throughout our telephone conversation, James dropped a lot of names.
I informed James of my terms to return the rifle I was going to ship him within 60 days or less. He agreed.
On September 13, 2011, I shipped a rifle to a Federal Firearms License (FFL) holder in Waterford, MI to the attention of James Hebert. James provided the information of the FFL holder. The rifle arrived at the Waterford, MI location on September 20, 2011. Heidi Kemler-Hebert completed a Form 4473 and the rifle was transferred to her. This transaction is considered a Straw Purchase by the ATF. Heidi takes possession of the firearms because James cannot legally possess a firearm due to his Probation and his charge of Aggravated Domestic Assault.
On September 20, 2011, Heidi proceeded to another FFL holder in Flint, MI and sold the rifle to the shop owner. The rifle was a custom built prototype with a Schmidt and Bender optic mounted to it.
There was also a custom drag bag with the rifle and optic.
On September 23, 2011, the FFL holder in Flint, MI listed the rifle for sale on GunsAmerica.com. The item number is 926195202. The FFL holder listed the Schmidt and Bender optic for sale on eBay. Listing information not available.
The rifle was sold to a customer in Austin,TX on November 15, 2011 and shipped to a FFL holder in San Antonio. The suppressor used by the customer was not compatible with the suppressor adapter on the rifle and the rifle was shipped back to me to have the muzzle threads changed.
Throughout the time that the rifle was being “filmed,” I attempted to contact James on numerous occasions and received no return phone calls or emails. After sending James a rather indignant email, I received a response that he had been hunting in Canada and had no phone or email contact. He also stated that he had five additional weeks of filming to complete. James was never hunting in Canada.
After receiving the rifle back in my hands, I tracked the location and timeline of the rifle, gathering all the information herein. I called James and he actually answered the telephone. I asked for an update on the whereabouts of my rifle and he stated that it was in Quantico, VA being used in a filming. I also asked if he ever shot the rifle upon receiving it and he answered “Yes” and went into detail about how well it shot. I asked what filming James has accomplished and he informed me that he had 70 to 90 hours of film footage. I asked him to describe the rifle to me but he couldn’t describe it to me at all. James never intended to film the rifle andvneeded funds to finance the BMX shop.
I informed James that I was impressed with his story but questioned the validity of his story, as I was holding the rifle in my hands in Montana. Of course James continued with his lies and deceit. This guy is a true predator and lives to be a criminal.
There are currently two Police Reports on file in this case. One case in Austin, TX, case number 1150565446, and another in Kalispell, MT, case number 2011-30124. I am pursuing James and Heidi for Theft by Deception and Fraud. There are also Federal cases being conducted as well.
I have learned of numerous other victims and am working to help in any way I can. I and others have rallied to collect information and supply a packet to numerous other Law Enforcement agencies and Legal Counsel.
